WHAT SHOULD I DO IF I WANT TO GET MY KID OUT OF COLOMBIA?

15 days ago, the law 1098 of 2006 started to rule in the aspect related to minors, including their criminal and civil liability. Despite the crucial elements that the code created, most people don’t know them yet.

For example, the law has to be applied to any teenager not matter if he/she doesn’t have the Colombian citizenship but lives in the country.

Another important aspect is the license to permit a kid to leave the nation.

First case: When the boy or girl is traveling out of the country with one of his/her parents.

1. A written permission of the parent who IS NOT leaving the country should be done.
2. This document must be signed and be authenticated by a notary.
3. NEW ELEMENT: The permission has to contain the final place of destiny, the purpose of the travel, and the date of leave and reentry to Colombia.

Second case: When one of the parents is missing and the other one wants to leave the country.

1. Any person who has the custody can asked for the permission-
2. Requirements: the petition must contain the reasons of the travel, the time of travel and the birth certificate of the minor.
3. The family’s defender will require the missing guardian that between the following 5 days after the acceptance presents in the office and answer the petition.

In case there is an opposition, the family’s defender will notice the family court.

If the permission is granted, it has a valid time of 60 days.
