Union Libre for a Spousal Visa in Colombia

Does anybody know what the Colombian statues say how long you have to prove that a couple is together for Colombia to recognize Union Libre which can be used to apply for a Spousal Visa and Cedula????


Also what requirements you need to prove this existence..

In Colombia Law 54 of 1990, Civil Code, known as the Patrimonial Deed between Permanent Partners (Common Law Marriage), by which a man and a woman, without being married, provided they make a permanent communal life, cohabit as a couple for more than two years and act in all respect as if they are married. All their possessions are shared at 50% each except those owned before the relationship began. Lots more ins and outs to this but hyou need a good Colombian attorney to explain the pitfalls and options available.

The most important thing is the declaration, before a Colombian notary, made buy each of you that certifies that yours is a common law marriage and you consider yourselves to be permanent partners. Without this in hand don't even waste your time and effort.

Will stick out the two years in see what happens..So basically a marriage is better because then the date would be the marriage date and not the date of when you started being together on the 50-50 Rule..

Wish I could get a Cedula another way.. Pension to much money and the business visa nada work in Miami..The one thing I would like to do is get my property before marriage if that happens who knows..

I would for a house if I puchased with all my funds...but if the spouse helps out then its a different story...At my age can afford to lose much anymore..38...Lost in my last marriage but was in my 20's and really didn't care and said took the loss and move on...but now smarter and older..

PANTHDAVE, just an FYI, when you get your spouse visa, it has the NAME OF YOUR SPOUSE ON IT, so if you are wanting to avoid a formal marriage to keep your options open so to speak, you are in for a shock when you get your visa. If you leave her or she leaves you before you are here three years and have your perminant residence visa,, I BELIEVE IT IS BYE BYE

At this point ready almost to pay for business visa...or just live on a Tourist Visa which is not so bad because need to travel back and forth to MIA anyways..Only investment more pages in my passport..and need to prepay for many things because I have no status without a Cedula..

500,000 is Davivienda and 400,000 BanColombia..but once I open Capital One will not worry about that anymore with no more international ATM Fees...

PANTHDAVE, if you plan on TRAVELING BACK AND FORTH TO MIA, you might have a serious problem, depending on the length of your stays. I can only speak for the spouse visa, but when you get it, it is only good for two years, then you must renew it every two years until you have been in Colombia for either three or five years, depending on who you talk to. I have been give the three and five year time line by different Govt sources.

During the TEMPORARY PERIOD, if you leave Colombia for more than 90 days per year, your visa will cancel automatically and you must begin the process all over again.

Someone correct me if I am wrong on this.

The Colombian "spouse" visa is initially issued for TWO years then must be renewed. Do NOT wait until it expires, allow sufficient time for the visa extension to be granted befor the ld one become invalid. After another year, THE THIRD YEAR, you may make application with MRE in Bogotá for a RESIDENT VISA. This is what I have. This visa has the following characteristics: allows multiple entrances, will expired if absence from the Colombian territory for TWO years, and you have the obligation to register with D.A.S, and obtain a “Cedula de Extranjeria�.

The resident visa has no expiration. So once you have it that's it. You must have the spouse visa for a total of three years before applying for residence.

I believe the other visa expire after 3/6 months out of the country. The MRE site has this information.

Gator, first time I was granted a one year spousal visa outside Colombia (I went to Panama to get it). Now, I was granted a two years visa by MRE. Anyway, it is true, they said that the third time I will be given a resident visa.
So for me, it was initially one year and then two years.

ROBI666, my first spousal visa was for two years, I renewed in Bogota for ANOTHER two years and am now eligable for the RESIDENCY, guess I just need to do the paperwork and get my hind end to Bogota.
