UK Visa questions

Hola todo's...

I have a couple of questions regarding an application for my fiances's marriage visa:

I am a British citizen and live and work in the UK, and my Colombian girlfriend of over 2 years returned to Colombia one month ago, due to her student visa expiring, and the extension for 1 further year was denied due to a breach in the working time regulations of 20 hours per week. My girlfriend was working 25 hours per week.

Our plan this year is to get married in Colombia, and return to the UK, however, will the application for a settlement visa be affected by my girlfriend's student visa extension being denied?

Also, if i decide to take 6 months sabbatical leave from work, or resign from my current job, effectively becoming unemployed, will this affect the settlement visa application in any way?

I do have substantial savings and a place to live in the UK.

Hello Addy, I don't know a lot about this but one of my friends had the same problem like your girlfriend and her husband flew to Colombia and got married there i think 20 days late and he stayed there for 3 months until she got her visa for 2 years, he is British and they went together to British Embassy in Bogotá and applied for her visa, they had an interview for about 1 hour and then she got the stam, which is like i said before a visa for two years with a work permit, that means she will be able to work full time or run bussines and travel any where of course applying for visas to some countries. After two years she can apply for her residence but proving that you have been living together since you got married.

PD: I dont think tehre will be any problem if you take 6 months off from work, as long as you can prove that you have money to support your wife over here and that you are not claiming benefits. You will have to take all your documents to Colombia (bills on your name, passport,if you any property all the paper related to that, and i think a document from the register office saying that you are single and never been married before (if you havent) but if you have paper of your divorce, paidsleeps from you have been working and the last three months statements from the bank.
