Tourist vs. fiancee

My novia is 36 years old with 2 kids (7 & 10). Does that increase her odds at tourist visa? Also, would it include the kids?

If she is denied a tourist visa, then applies for Fiancee visa, does it hurt her, since it looks like she tried to get in just to get married? Finally, what is estimated time for approval of a tourist visa?

There is no way on God's green earth she is going to get a tourist visa for herself and her kids. Don't waste any more time and/or money - just get the K-1 and be done with it.

Disclaimer: any comment I make is inane and is not to be taken seriously, and is so patently ridiculous that no one should take it seriously, even as an insult.

In addition The tourist visa will take longer. And never have her lie about her visit. she is setting herself (and yourself) up for heartache going the tourist visa route. Assuming you intend to marry her and then have her remain.

I went the K-3 route but the K-1 is much faster now from what I hear.

getting married the tourist visa is imposible to get unless she otherwise qualifies i.e. she proves that she has the intent to return to colombia after her visit. this intent is demonstrated by bank statements, income, job stability, land or homes and other evidence of economic stability.

the easier route is the fiance visa. it is easier and rather routine if you have minimal financial resources as demonstated in the affidavit of support you will have to provide. the children are allowed to travel to the us with a fiance visa.

filing one before the other really does not have an effect since the lady has to return after 90 days if you do not marry in the united states.

Filing for a tourist visa Will not hurt her chances in and of itself. Lying baout your true intentions may. My wife had applied and been rejected twice. The K-3 was no problem...other than the wait.
If you file a K visa then a tourist visa you will be rejected...period.

If you file for a tourist visa it will take over a year IF she is sucessful. Then you will have to contend with lying about your true intentions down the line anyway.

Last time I checked the fiancee visa was the fastest. But that has been awhile. Immigrations is an everchanging entity.

If I were in your shoes I would file the K-1.

Good Luck,

Tony
