Supreme court rules that music downloading is legal in Colombia

BOGOT� (AFP) — La Corte Suprema de Justicia de Colombia determinó que bajar música de internet no constituye delito, siempre y cuando de esta actividad no se obtenga ningún provecho económico, en una sentencia divulgada este lunes.

El fallo, cuyos apartes fueron reproducidos por la prensa, señala que cuando no se obtiene lucro respecto a la obra "resulta imposible afirmar la existencia de una conducta punible".

El tribunal emitió el fallo al revertir una sentencia a 24 meses de cárcel y una multa de 2 millones (1.100 dólares) contra una persona que realizaba copias en formato Mp3 de discos de vinilo que le suministraban sus clientes.

La Corte Suprema de Justicia revirtió esa condena señalando que las copias realizadas por uso personal no podían ser penalizadas pues no provocaban un detrimento contra los intrereses de los autores.

El fallo también determinó que cuando una persona comparte la música con otras sin obtener de ello un provecho económico, no puede considerarse que afecte los derechos del autor.

Who knows... this is such a fluid area of law these days. Allofmp3.com seemed to have a couple of Russian and Moscow-based court rulings on their side and they are still out of business. Maybe when it's all sorted out the businesses like allofmp3.com won't be permitted but the record companies also won't be able to go after individuals sharing their stuff (however obtained) for free.

Esta es la misma ley que existe en los EEUU cualquiera puede bajar musica lo que no se puede es robarle los derechos del autor como fabricar o quemar CDs para la venta.

Colombia follows US it's basically the same law.

You can still download music today! There are several software available to download music.
I just finished a project at Starbucks, we were installing IT servers so now customer can download music into their ipods.
It is illegal however to copy or burn CD's with the intent to sale them. I am glad Colombia is Not turning now into another illicit business.

Accoding to the law as you see it, ""El fallo también determinó que cuando una persona comparte la música con otras sin obtener de ello un provecho económico, no puede considerarse que afecte los derechos del autor." So now you can go to Colombia and make a million copies of a CD or DVD and distribute them to friends and strangers, Am I right?

Music labels promote CD burning of downloads

Universal Music Group has announced that it will make more than 43,000 music tracks available to consumers for digital downloading through retail outlets and music web sites. UMG said the downloads can be burned to CDs and transferable to secure portable devices.
According to UMG the digital tracks will be available for purchase by consumers in the US for 99 cents for individual tracks and $9.99 for albums. The technology behind the service is provided by Liquid Audio, and users will be able to preview and purchase music tracks in both the Liquid Audio and Windows Media formats.
Earlier this month, Sony announced that it has teamed up with nine distributors of digital music, including Rhapsody and MusicNet, to allow consumers to burn a limited number of songs onto blank CDs. Sony also said that it will offer users the option to buy and download singles from forthcoming albums when they are played on the radio.
In the past, most music labels attempted to sell digital downloads, in order to compete with file-swapping services. However, such downloads were only available through restrictive monthly subscriptions and the tracks would expire when subscriptions lapsed. Users were not allowed to burn songs or transfer them to portable players.
