Support Affidavit ?

I married colombian women in colombia 6 months ago.We finally got all the paper work approved on the USA end,now all paper work is in colombia. I filed a I130 then 2 weeks after i recieved a receipt.At that time I filed the I129f post I130,which now she is gonna try to get a K3 visa.We try to call the embassy in colombia or even here and they do not help much and thats nicely put.Do i need the I134 form done as well? If so,do I need w2 or income tax forms,b/c i dont have either.If i do need tax forms,which i do not, would I need a co-sponser,do they need both the w2 and income tax forms or one or the other,and do they need to be for 3 years prior,b/c thats what the packet said to my wife,but she is a bit lost just like me.The form I134 on the website USCIS says just need a statement from employer and bank as well.Im not sure what we need,we are finally at the last step....Please if anyone can help i would appreciate it...

Yes you need Tax forms. I do not think you are at the last step. It sounds like she recieved the list of missing documents. You need to prove the ability to support the new immigrant(s)in addition to any others that depend on you. If you have a very large bank account (100K plus), that will work, otherwise you have to prove your income. You need tax forms for the past three years (something official that shows your income for each of the three years). If you did not file, you have to file or you have to explain why you are not required to file (L&I benefits or low income are potential reasons). You need to prove that you are above the income threshold to support the number of dependants that will be relying on you.

If you did not have enough income in the past three years to surpass the threshold, then you will need a co-sponsor and the co-sponsor will need to prove the ability to support the immigrant. They will be on the hook for ten years.

Same Situation Hi Sean - I am at the same point as you are. My wife just got the packet from the embassy and as we speak is attempting to fill out the paperwork. I DL the foms here and we have been going line by line on them. The w-2's and tax forms are necessary as well as evidence of bank deposits over the last year. Also I had to get a letter from the bank stating when I opened my account. It seems that the closer we get, the more they want. Anyway, good luck. Maybe we will meet at the embassy!!

Yep I agree I didn't provide bank or asset info because I qualified based on my income alone. And, I haven't provided bank info for the AOS (green card) either - interview this Friday. Good Luck on whatever makes you comfortable sending.

That is you have not given enough information for even the most knowelegable person to give you an intelligent informed answer. The correct answer will depend on several factors. We you married for any of the prior three tax years? If so did your spouse at the time have income that was included in your return? If so, YOUR W-2 is critical to proving YOUR income.Are you in the military? Which state do you reside in? How many dependants do you have?

In my case my exwife was holding my paperwork hostage; but, the IRS faxed me my three years prior returns while I held online to ensure that I received them...your tax dollars at work!!!

Get the affidavit of support and poverty guidlines work through them and your questions will be answered. If not THEN you can ask an intelligent question.

It is possible to get many good answers in the internet; but, there is just as much false information. For as far along as you are in this process you seem ill informed about the process. Get busy and do your homework or you are probably suffer some very disappointing time delays.
