american fiance wants to adopt stepchild once he gets married to his soon to be colombian wife, colombian wife lives in europe with the child and have applied for fiance visa which has been approved, question: how can he adopt child in the states, child has two nationalities, one is colombian, child has no contact with biological father and doesn't have his surname, he does not appear on her birth certificates. will they treat it as an intecountry adoption or just as a stepchild adoption, what are the laws for texas or DC if anybody here knows anything that would help us out please do let us know we would really appreciate it, thanks.

TioCharlie says on Dec 31, 2007, 00:06: I am asuming that your friend got an I-90 Visa for his fiancee. After the marriage he/she will be a permenant resident (not a citizen) for the next 5 years. The child can get a Visa as well to immigrate with his parent to the U.S. After the 5 year period, the adoption can take place as a normal stepchild adoption. Until this time, your friend can try an international adoption.

Last I heard that was an application to replace LOST I-551 (Green Card) When she gets marriaged, with in the 90-day time frame, the wait to apply for US Citizenship is three years, not five.
