Specific questions on the K-1 process

Hi everyone. I am new to the site, and I live in the US and I am beginning the K1 process for my fiance in Colombia. First, let me note, that I have read the first of the three pages of the "All about visas" section in the Discussion area - so I'm not asking questions without having done some homework. Oh, and I've spent a few hours (although certainly not finished yet) reading the visajourney.com and uscis.gov sites.

The Texas USCIS processing status url still lists Aug/2004! Do you think that's correct or they're just not updating it? I know it's not VT, but it can't be that bad, can it?

I'm hoping to have my fiance/wife travel with me, both during the 3-month pre-marriage term and the 2-yr post-marriage term (sorry I don't know the formal names for these periods/terms) - do you know if I follow instructions (e.g. the Advance Parol application) is it permissable (might she be granted permission) for both of these periods/terms?

Do you know a good contact in Bogota if we run into a lost Forms and Checklist package sent from Bogota Embassy to her (beneficiary), as I hear this is common?

4)
I've seen conflicting recommendations in posts - do you have a recommendation on how many orginal G-325A forms (for me, for her) I should include in K1 package to USCIS?

I'll try to help 1) It's that bad! If you're fortunate enough to have two addresses in the U.S., you could you the Service Center for your alternate address. Hopefully it's in the Northeast!
2) I believe the Advance Parole application is only available AFTER the marriage....not before.
3) You can get a new package from the embassy. Check the website for the hours that they are available for US Citizens.
4) You need two G325s for both parties. There is a fillable PDF you can download from the USCIS website which prints two copies automatically.

Make sure you send all 4 copies and they are all signed. Remember that you need 4 identical copies of the G-325A for you, and 4 for your fiance.

Note:The G-325 and G-325A look very similar. I am not sure if they are the same form or not. However, the USCIS website says to use the G-325A, so that is what you should use.

k-1 I am in the K-1 process right now. As far as the traveling. Once she enters the US she can not leave until she gets her Advanced Parole. You can not start that process until after you are married. The timeline is a few months. However they state that once the paperwork is submitted you can go to the local office and they generally are able to get one to you quickly. Maybe even that day. However you have to start the Advanced Parole process and there are no guarentees that they will give it to you quicker. As far as the G-325. They previous post is correct. You need three identical ones for each of you.

As for travel allowance - specifically can Advance Paroll be granted so she is eligible to travel between arrival and marriage (90 day period - assumes marriange closer to Day 90 vs. Day 1) - does anyone have personal experience on this topic?

Look, the instructions say one G-325A for you, and one G-325A for your fiance. There is a reason the G-325A PDF file contains FOUR (4) identical copies of the same page. Do you think the government did that for fun, or it was a mistake? Why the hell would it contain FOUR identical pages if you only needed one or two of them? Use some common sense. Also, if you call the USCIS forms request phone number and request a G-325A, you will get a form that has FOUR (4) carboned copies. If you use the fillable PDF or the paper form directly from the government, you only fill it in once, but you send in all FOUR (4) copies of it.

Take a look at visajourney.com. This is probably the best website you will find regarding a K1 visa. Their instructions say over and over again, FOUR (4) copies of the G-325A for you, and FOUR(4) for your fiance. It is right there in english.

Frzdan's right on the G-325. As for getting AP for the time between when she arrives on the K-1 and marriage, no, it can't be done. The K-1 is a temporary 90 day visa good for a one-time entrance for the purpose of marrying. If she leaves before you marry, you must start all over again to get her another visa. Once you AOS, you have to get AP (K-3s do not have to get AP because their visa is a multiple entry visa) and usually you can get that within a month or two of applying.

Can I create a one-page "proof sheet" by creating a single page that has say four photos which clearly display a timeline (hair length, braces on or off, etc.) with typed descriptions next to each photo, or do I need to go as far as cutting each photo down to a "photo size" for submission with I129F package? I only have digital photos, but I could print out on photo stock and cut each one out - do I need to go through such pain either because they want them that way or to disguise that they are digital vs. film photos?

FC-029 This is a one page statements that says "Copies of documents submitted are exact photocopies of unaltered original documents and I understand that I may be required to submit original documents to an Immigration or Consular official at a later date." Then you print/sign name and date it.

I've never seen anything requireing that this document be included with any petition.

I think it's just an old INS form

Dan says he's never seen anything stating it's required. I agree as neither paragraph 6 (What Documents Do You Need) of the I-129F nor anything at USCIS.gov state its requirement.

But the step-by-step guide for the K1 filing at www.visajourney.com/forums/index.php?pg=k1guide not only say to include it (in step 3) but provide an example of it. It is the exact paragraph that they place at the end of their example Cover Letter.

So, I'm still left wondering if it's needed or not, for K1. Thanks!

flaleo I went to the Texas service center in Mesquite and asked about the photos. Here is what they suggested to me.
Make a proof sheet where the photos are at least 3X4. On the back of each photo using a felt tip pen so as not to leave any marks on the photo, right the full names of each person ( first name last last names first) in the photo and the date the photo was taken. Put them in an envelope and use a plastic paper clip and attach them in the order suggested. I put the names on every photo sent and had the proof sheet notarized on the back. I also did that to my passport photo(s) and used the felt tip pen.They said the reason for the plactic paperclips is to insure they do not leave any marks on the photos.

Notarizing The only thing I've ever seen about getting notarized is the Affidavit of Support. Other than that, nothing in the application forms, that I've seen, say anything about notarizing.

flaleo You can do what you want here but I notarized everything that went into my package. I mean everything. The reason is that I did not want any problems with them over something so simple. My bank did it for me for free and I notarized about 15 documents including my back of all photos. My feelings are simple. Better to have then not to have. After all there was no cose to this.

Likewise (more or less) In my I-129F package, none of the forms were notarized except for the birth and divorce certificates which come with a seal from the state.

My package was approved two weeks ago, 63 days after receipt by the Nebraska Service Center, so they didn't seem to mind.

Now, I'm waiting for it to go to the embassy via the NVC....

Recent k-1 experience Filed 129-F at Texas 12/30/04, sent to CSC within a week. 4 copies of G-325A, all signed with original sigs, also the covet leter, Included the FC-029. Used digital fotos, but printed and cut them to the required passport size, names on the back. Nothing in the package was notorized. We did include english translations of spanish birth certs. We received NOA2 approval mid Feb. No outside travel for fiance until after AP is issued. We had the embassy interview and approved April 11. Don't forget to include all the proof of relationship, visits - passport copies with notations of entry, tickets and boarding passes, phone bill copies, etc. Good luck.
