So what happens...

Hey so she is there and it is all different from waht she expected...he has no intention to marry her and her time is almost up...
Waht can she do to not go back home..I know you will be objective about this..
There is no happiness in her heart and she feels that they are not right for eachother....]

The woman happens to be a very smart girl who gave that asswhole the opportunity to live in Colombia but she sold it all to follow his stupid ass....Now it all has become a living nightmare for her....


I want an opinion from a real MAN with a real antena not a"chito" who cares about helping others not from a selfish pig point of view.. sorry if you haven't had a good share of good women....

I don't know how much she can make but not fun working and going to school. I did it in the 70's (on a student visa) and got paid the minimum wages - $1.65 an hr I think! You can't do anything on that and the school fees will eat her up alive (mine were still being paid for by the sponsor.)
So, unless she has marketable skils (e.g. software etc.) she is not going to make enough to pay for her school on her own (and savings - that's even harder on non-professional wages.)
My intentions were to finish my schooling; after which I went back to India and came back a few years later on a green card. But you can't do any savings on being a student and not making decent money. Good Luck

From waht I know she was going to school in the usa and she came back home to see her sick dad and she lost her student visa she did not care and she lived in Colombia until she met her b/f last year. Her time is almost up and she is thinking how she will make it the rest of the year .. with out a job down here...

Is she in the US now with a fiance visa? (the 90 day visa?) If so, if she does not return as promised, once she gets caught, she will be deported, and probably banned for 10 years..and have absolutely NO credibility on her next application..i suggest returning at the b/f expense, and apply for the other visas......but with IMBRA nowdays, it will be on her record that she has been to the US on a fiance visa, which will make the Bogota embassy really scrutinize her next visa application....and to marry another citizen immediately is probably the worst thing she could do..but as always, check with a licensed and active immigration attorney to be sure....legal advice over the internet has its own inherent faults....

Just my opinion...

Some good advice above. The K-1 is a non-immigrant visa and you can't change one type of non-immigrant visa for another. Tinto outlined three options for her.

Fully agree with MC and Tinto on this.

The only other option/idea I can think of that she can do is to find a potential employer (here in the U.S.) that would sponser her for a work visa (HB1 visa?) AFTER she returns to Colombia.

Just a thought.

There's nothing wrong with going home 'empty handed' I would rather do that then charge thousands on my credit cards and run! Yes a few have done that. There is more personal integrity in falling down on your face and getting up on your own and making it than in coming home with a few hundred or thousand dollars to showoff how well you did in USA when in fact you didn't!
The fact that she didn't finish her school is bad; the fact that her relationship/marriage didn't workout is worse; the fact that she goes home without a penny - is NOT! The most valuable thing she has in her pocket is Time; and she shouldn't waste it dillying, dallying here - go home and try to make it - she will feel better for herself eventually.

Tinto I met someone who had similar circumstances a few years ago in Florida. She also missed her mothers passing and funeral. She was at the time making fairly good money in the restaurant businessas I understand.

But I could not live with the constant pressure and worry about what will happen at the next door knock or telephone call. Or major illness.NJ and Florida have extensive Colombian populations.

My advice would be for her to return but that is a personal decision.

On another note it is extremely rare for the USCIS to deny the spouse of an American Citizen. I know of a case personally were the woman was caught redhanded with a counterfiet passport. She found a sucker to marry her make the application and waiver requests. They were granted and after two years of being madly in love she dumped the gringo when he wasn't needed.

I have to confess that I almost pulled a "DonGringo" until I read this (the 47th time). That is quite unusual from what I have seen. The more common scenario is the one DonGringo assumes in his response where the foreign woman says and does all the right things until arriving in the U.S. when, all-of-a-sudden, decides it's just not working, but, thanks for the visa! You might want to cut DonGringo just a little slack in case he misread the situation.

If the guy dumped her, once she arrived, that's good news and bad news. The bad news is that her heart is understandably broken and my heart goes out to her. The good news is that finding out the guy's a flake BEFORE they got married just saved her from years of heartbreaking marriage. It probably doesn't look good now, but she should be counting her blessings.

From what I've read (and re-read) here , the best thing she could do is go back home and be thankful she didn't marry the jerk. In spite of what some people think, no marriage is better than a bad marriage.

If is just embarrassment... If she's just trying to avoid the embarassment of returning "unwed," then the best thing she can do is come up with an acceptable "story" for those who might talk. I don't know her, her family, or her peer group, so I don't know how much reputation is at stake here, but it would really be a shame if it were better, in the eyes of her family and friends, to stay in a relationship with a jerk than to come back home, single.

My guess is that the "fear" of embarassment is much greater than any actual shame she'll face. Which would be understandable in the middle of such a heartbreaking experience.

ya know, this almost sounds like my reaction to when my sister in law brought up the whole subject of my wife, after her trip there with one of our nieces. she mentioned to me that she may have someone for me in colombia, and my first reaction was to ask her (half jokingly) if this was some sort of "green card and gone" deal. she said no, it was nothing like that. spent 3 yrs getting to know her, 1 yr engagement, and now married for a little over a year, with the last step in the immigration process in sight. i guess i'm one of the lucky ones with a colombiana with her heart in the right place. =)
