scumbag of the year

A friend of an old girlfriend is getting screwed. Carolina lives in Colombia with her three year old daughter. Her husband immigrated to the USA several years ago, and the plan was that his wife and daughter would join him once the paperwork was completed.

Carolina he is not a citizen yet, but he must have a green card, because he returned to Colombia for a visit in July. While he was in Colombia, Carolina confronted him about when she was coming to the USA. He was lying the entire time, and has taken no steps whatsoever to file the necessary papers. Not only that, he categorically refused to provide a letter giving his permission for their child to leave Colombia, which is a requirement under Colombian law. If she takes any steps to leave Colombia or to divorce him, he threatens to end his already sporadic and inadequate child support payments.

How can someone outside the USA enforce a child support order against a resident of the USA?

Who can assist with this process?

Would these issues be of interest to the Immigration authorities?

Could his willful neglect of his wife and daughter have any affect on his immigration status?

About the question, it is very difficult to make some kind of advice right now. The first thing that you need is that the defendent is the father of kids. To prove this, you need civil record, document where the parents are registered.

I can tell you more, but its case may be different if there are marriend, live together or just had the children.

Something wrong here you can NOT sponsor a spouse or ANYBODY else into the USA unless you are a citizen. You can't even START the paperwork without citizenship. A green card does you no good whatsoever.

I wonder if the story is correct or if there is more than one side to it!

That was the case when we applied for US. residency albeit a long time ago. My brother (US citizen) petitoned and sponsored me, my husband and children were automatically included.

If this is still valid then somebody is lying.

If he "immigrated" several years ago he has not had enough time to obtain citizenship.

I would think that if she wants to she could file paperwork with DAS. I know when my wife and I were in line at DAS occaisionally they called people aside. My wife indicated that most of the time it was about child support.

A green card holder can petition for their spouse but there is a very long wait. Usually by the time the spouse's visa priority date is close to coming up, they're already citizens and they get them in that way.

If she gets paperwork from DAS, how can she enforce it in the USA?
