Process Once Bogota has Everything (fiance visa)

I have a general question, and the reason I ask is because during this whole process of trying to get a fiance visa for my fiance in Cali, there were three times now that we waited longer than necessary and time has wasted away.

My situation: We have an approved petition from the States (I-129) and it has been sent down to Bogota already. We sent in all the required forms (DS-230 and OF 169) the end of last week, twice actually and mailed them as well. Anyway, I realize that it could take up to two months to hear word from the Embassy with his interview date, but is there anything that we could be doing in the meantime? Is there anything that we should be prepared for? I keep reading that the embassy just keeps requesting more information and losing documents. I'm nervous because they don't even notify you when they receive the documents on their end.
I'm trying to plan our wedding here in the States, and I am hoping that he will be here no later than April or May.
Any suggestions or guidance would be greatly appreciated.
Thanks!

Don't plan on anything concretely Don't sign any contracts or set a date - the visa may or may not be granted by then though its definitely a good chance that it will be if all your documents are in order and you make enough money to support him. Bogota is good about giving out visas but every now and then the K1s are denied (or delayed) for lack of documents/incorrectly filling or not filling them out completely and most of all for insufficient or missing support documents (I134 with employment letter and Tax returns etc.) I would suggest not to set any dates or book any halls or pay for anything till he does get the visa. Good luck

Confused... I'm a little bit confused. When we submitted the paperwork to Bogota, they did not ask for any of my information regarding my salary or taxes. Did we miss a form?
The only forms that we sent in order to schedule an interview was the DS-230 which was basic demographic information on him (my fiance in COlombia) and the OF 169 which was the checklist. Is there something else??
Or do they ask for that information when he recieves notice of his interview date?

It should have been on the checklist You need to supply an I134 and three years of tax returns and a letter from your employer stating your salary (when he received the checklist it would have asked for the above - ask him to re-read it.) Good luck and don't worry - the I134 - you can download from the USCIS website and print it out - get it notarized and send it to your fiance with the supporting papers.
If he is getting close to the interview then fedex it - it will cost a lot (approx. $50 or so) but they will get it there in a couple days.

Now I'm Concerned We downloaded the forms from provisa.com. He never recevied his packet3 from the embassy so someone from this website told us to just download the forms.
Are you positive that for a K-1 we need to have that form before he gets his interview appointment. All the checklist said that he needed to send in was the DS-230 and the checklist. ***I'm starting to panic again*** :)
If I need to get that in order to have them send his interview date then I will, but I'm still concerned now that maybe he sent in the wrong forms.
ARGHHH!!!! This is really stressing me out now. I almost wish I would have gotten an attorney and paid the $3000 just to not have to worry with any of this.
Please let me know your thoughts on this. Thanks for your help.

Crazy4Cali says on Jan 18, 2006, 19:33:

If you/you're fiance read the packet... The form says: Collect the items from the checklist, then send in the forms OF-169 and DS-230 (it says DON'T send the checklist).

And don't worry about the attorney. If you'd gotten an attorney, you'd still have to collect all the information (which was the hardest part for me) and then hope they get it all done in time...and you'd be out $3000, to boot!

No need to panic, though. If your fiance has sent in the OF-169 and DS-230, then you still have some time since your fiance's appointment won't be for another month in the best case.

BUT...

you should go over the list of items with your fiance. Most of the forms are your fiance's, but you (the sponsor) will need to complete a form I-134 and provide all the required supporting documentation.

If you go to visajourney.com, they have both the forms and lots of helpful advice.

After you collect all this information and fill out the form (it's a lot like doing your taxes) then you'll need to send it to your fiance by a reliable and quick delivery service so your fiance can carry it to the interview in Bogota.

Don't panic, but get going!

good luck!

You're the best! Crazy, You are the best. You are so knowledgable about all this stuff. Since we never got the packet, we had to just download the forms, so I guess I got the wrong ones because it never asked for my information, I134, but I will be sure to get it. Just to repeat...I'm not thinking clealry, we didn't need to send that in with the OF169 and the DS-230, he just needs to bring the I134 to his interview??
Are you living in Cali now?

Crazy4Cali says on Jan 19, 2006, 12:22:

Correct... On the forms, at least. You just need to get the I-134 filled out, notorized and sent down with the supporting documentation to your fiance so he can have it at the interview. Your fiance will also need all the pertinent items from the checklist so look that up (it's somewhere on this site).

However, sadly, I'm not in Cali, my lovely Colombian wife and I are here in the U.S. after going through the same anxieties as you about a year ago. Don't worry, just dot the i's and cross the t's and you'll do fine.

Hey mire If you read again what I wrote and crazy wrote you will have the info you need. You must complete an I134 (download it from USCIS or visa journey or...) then get it notarized and attach letter of employment showing your salary and 3 years of tax returns and send it to him (keep a copy with you - you may need it at AOS.) Don't panic - you have time - relax - read and reread the posts here and on visa journey - send a check for $3000 to PBH Colombia! Good luck

Forms Hi mireland511,

Your best bet would have been to fax and send by courier (Servientrega, etc.) a copy of your fiancé passport, OF-169/DS-2201 and DS-230 part 1. That way they have no way of losing it. The cut-off date is the 20th of every month. If U.S. Embassy receives those forms by the 20th then your fiancé will have the interview the following month. The forms that your fiancé needs to have ready are the DS-230, DS-156 (2 copies), DS-156K plus all the other documents they request birth certificate, divorce certificate if he was married before, immunization record, police report, etc.

What you need to have sent him would be the I-134, bank letter, employer letter, 1040 tax returns (3 years), transcripts from the I.R.S. (a plus), bank statement (1 year), pay stubs ( 1 year or a time period).

Hope this help you. You should read all you can at www.visajourney.com they are a very good source of information and you could ask questions.

Good luck,

Peter Miami

Thanks Again! I went onto visajourney this afternoon and I printed out the I-134 and the steps or timeline for the K-1 that they have, so that information in addition to everything that you all have told me has me feeling a bit more relaxed.
Does anyone know how long we have to wait until he gets something from the Embassy regarding his interview date? I see that if they receved everything prior to the 20th of the month, his interview will be next month. They should have receieved everything last week, at latest this past Tuesday. I thought I read somewhere on visajourney that once they receive everything he will get his date for the interview within a week and the interview will be within a month of him getting notified? Does that sound correct. It seems really quick to me. Thanks!

You can check it after the 20th Here's the website http://bogota.usembassy.gov/wwwfivad.pdf - You will need the case #.
They will post the February interviews any day now - they don't always do it on the 20th - sometimes it goes into the next month and in my case we had received the interview letter from Bogota before the site was updated around the 4th of the month! Good luck

mireland I think you can plan on a wedding... if you are planning on a small wedding with friends you can tell warn them that there is a slight chance that you have to switch dates.

We planned on a wedding for october thinking that we would have the visa in september, we talked to vendors, sent out invitations, got dress, etc etc... They only think we didn't do was give money to the vendors (we just did it when I got my visa in hand).

And then we ended up getting the visa in july and arriving to the country at the end of that month. So at least that you have a difficult case (that you don't speak each other language, that you are barely over the minimum income required, that you can't get a document, that you have filed other k-1s in the past, etc.) I wouldn't worry much.

I don't know I just say it based on my experience.

Good luck!!

Silvia

WOW!!!! Where were all of you two months ago? You are a wealth of knowledge. I can't thank all of you enough for all the information that you have given me. I had no idea about the websites or anything. ...I just checked and they have not updated it yet...
Honestly, I am so thankful that I found this site and that all of you are so open with your experiences and knowledge. You've helped me so most.
But don't go anywhere, I'm sure I can come up with some more questions.. Ha Ha :)

I-130 approval and the I-134 affidavit of support Crazy4cali-
you seem to know quite a bit about all this. I have searched and read several threads now on this, and here is my question. I applied for the K3 visa for my wife in Cali, and I finally received an approval on this end (USA). I already sent in the I-134 here in the USA with my other paperwork. Now in order for my wife to get the interview I have to send it again?!? Is this correct? I only ask because being self employed it was a PIA...

If so I will have to get in gear...
Thanks

The I-134 is among the documents that your wife has to bring with her to the interview. It is not something that you send with your K-3 petition to the USCIS.

Disclaimer: any comment I make is inane and is not to be taken seriously, and is so patently ridiculous that no one should take it seriously, even as an insult.

what he said you should send your I-134 to your wife. If you sent it to the embassy, they may or may not have it, but I wouldn't count on it either way.
