marrying a colombian tourist in canada

if i marry a colombian tourist in canada does she have to leave the country to apply for residency, or is she okay to stay in canada?

hmmm I might be mistaken... but during my research I came across something that if you applied for a spousal visa from within Canada, while your spouse is in Canada, your spouse had the right to stay within the country until the visa was decided. The trick is getting your potential spouse to Canada in the first place... but if she is already in Canada, then the tough part is done. This is known as 'in country' processing, as opposed to processing the applicaiton outside Canada. You need to verify this, cause I do not recall the details... (and maybe I am wrong, or things may have changed). Good luck.

She's OK!! I have a friend who married an indonesian girl brought her here as a visitor and while she was here processed the permanent residency application it took 11 months.
Better yet less trouble for you all she needs to get from colombia is her registro de nacamiento,... mom can get that and her DAS security check can be done for her by mom too,... all the rest of paperwork can be done in canada.
They used to make it really difficult for people who skipped the line like that by comin as a visitor then marrying but new government made a new policy to stop punishing people like that by taking so long.

Tom... the only trouble is getting a TRV for the colombiana to come to canada in the first place. I know about 6 people that have applied for the TRV for their spouse/bf/gf, myself included, and none of them have been approved. If however, before you marry, your potential spouse is already in Canada, and then you marry and apply for PRV, then she is entitled to stay in the country. At least this is my understanding.

Tom...after I reread your post... there is one potential problem with what you suggest about your friend. If you marry before applying for the TRV (visitors visa) and later when you apply for the TRV, and you decide not to mention your marriage, this could cause big problems with Immigration Canada... especially if they catch you or the spouse, and if/when you apply for the PRV.

I am interested in your comment that all she needs is her birth certificate and DAS certificate. Can you elaborate... Do you mean once she is in Canada, this is all she needs for the PRV, or she only needs these two documents for a TRV???

Do you have other experience with Immigration Canada that you can share?
