Married to a Colombiana

I was recently married in Colombia and I have filed my petition with the California Service Center. Can anyone tell me how it will effect the process of obtaining a visa for mt wife and her son if I were to go live with her in Colombia until she is allowed to enter the US. I have a stable work history in the US and enough money in the stock market to sustain us for a quite a while, but I will not have a job when they request W-2's and evidence of a job. Will this keep them from approving my application?

Paperwork As part of the paperwork, there is the Affidavit of Support. Part of this packet requires a bank letter that shows deposits from your bank and current balance. Also required, is the reporting of any other financial income (your stocks you mentioned) and what that is all worth. If you can show that you have enough to support the rest of your family and can meet the 125% poverty level, you should be good, otherwise, I think you may need a co-signer. There is info online that show what the current Poverty level is, so I don't remember what it is off hand.

Even though I had WAY over 125% to support my wife, they gave me a hard time. Actually I tend to see the same guy at the embassy everytime I go, has an attitude. He said I needed a cosigner. I showed him all my bank stuff and told him he was acting ridiculous. He ended up seeingit my way.
Same attitude from the same guy when we went for my child´s Citizen born abroad certificate. He called our name and my wife was breastfeeding in a quiet place outside. He said he´d put my daughters form on the bottom of the pile and it may be several hours until he got back to it again because he had to see the baby. I told him he couldn´t just hand us the form when he sees us back in the room with the baby, "You F***ing A****le" Everyone looked and laughed. We all came in the room not five minutes later and all smiles he waves to us and calls our name out and starts acting all buddy-buddy.
If they give you a hard time because it seems they can, and you know you are right, stand up and tell them so, it worked for me. I just wouldn´t be so vulgar the first time. I only was because it was hte same guy with an even worse attitude than the time before.

You need 5x the poverty guideline Folks, be careful here. The law is VERY specific. If you have a job you fall into the 125% category, and even then they can probably give you a hard time if you just got a job and your past income tax returns are under the 125% rule. If you DON'T have a job, the 125% rule totally changes. In that case you need to show that you have 5X the 125% poverty guideline. In other words, if the 125% guideline in your case (depending on how many dependents) is $15,000, you need $75,000 in cash, stock, or real estate equity.

See form I-864 instructions for the specific wording on this, "evidence of assets" section.

Bufalo - were you working and over the 125% guideline or were you not working and only had assets over the 125% guideline? Just curious.
