My future wife and I would like to get married now that she is here in U.S. on a tourist visa... I need to know exactly if there are any penalties of somesort..in a year we would like to be here in the states living together, so i have no idea on the time process if she goes back to colombia withouth getting married to me and then the waiting process ...so i figured if we get married now that she is here and goes back to colombia in november, she would have no problems getting here in a year without a waiting process because she would be married to me ( a US citizen)...
PLEASE i need the facts and need to know what you guys know about this situation..is it easy?? DO i go to my city magistrate and we get married .. would she have any problems now or later if she would to get married on her tourist visa now ????
HELP..INFO INFOOOOO
thank you soo much

john_stark says on Sep 2, 2007, 08:50: A lot of people marry while in the US either on a tourist visa or on the Visa Waiver Program. However it cannot be a premeditated event, it must be a spur of the moment thing. If she entered the US with the intention of getting married her subsequent AOS application could be denied.

Robert Jorge says on Sep 2, 2007, 20:08: Yep, I agree with the above posts. It may seem simple, quick, and a well intentioned thing to get married while she is on the tourist visa. But, Gator and JS are correct. Many people do it. Some get away with it. Some don't. Give yourself peace of mind, and do it the correct and legal way. (Not implying you intended to break the law) And anyway, if you go the K1 route, like Gator said, you are looking at 6 or 7 months. So that puts you well within your year time-frame. A K3 takes virtually the same amount of time, but keep in mind all the prep time for a marriage in Colombia. If it takes you 6 months to get married in Colombia, only after that can you even start the K3. BEWARE of gold diggers. 0 funny, 0 helpful. |

slguy says on Sep 3, 2007, 12:50: wait a minute. how can this be considered visa fraud, if she returns to colombia when the visa time is up? And the OP is talking about applying to get her in the States permanently in a year. Where's the fraud? Before you throw me out, make sure I pay my bar tab 0 funny, 0 helpful. |

Gator says on Sep 3, 2007, 19:16: She is in the USA on a B1/2 Visa. If USICE feels she used the B visa to circumvent the K visa requirement THAT'S what could be visa fraud.
