Malpractice in Colombian

Does anyone know if there is such a thing as malpractice lawsuits in Colombia? i realize its probably not the same as the USA malpractice lawsuit, but maybe similiar. I have a friend who lives in colombia who got some cosmetic surgery done and afterwards almost died due to an infection she got from the operation. the doctors kept telling her it was this, it was that, they never gave her a straight answer. she had a very high fever for days, very weak and almost had no pulse. she went back to the doctor everyday to find out what was causing the fever but they didnt know. she barely made it through. What can she do, at least get her money back from the operation and all the medicine she paid for? or could she sue for damages for pain and suffering as well? Also, she told me since she only paid half of the cost of the operation, and the rest on credit, she would have to pay the full amount first before it starting the case or "demanda" or tetula??? Why would she have to do this, doesnt make sense, or is this the way colombia law works? thanks

Even in the US there's a surprisingly high bar on malpractice and in Colombia that bar is somewhere higher than the moon.

Been there, done that.... We looked at all the options, just short of "offing" the surgeon out of revenge (would be cheaper than hiring an abagado for a legal process that would eventually fail you). EVERYTHING you explained happened to my wife after a dual surgery, resulting in removal of her implants just weeks after they were inserted and follow up on her lipo to even out the work. She almost died over the infection.

What has been our answer? Find the best surgeon we could in Bogota, and pay every penny necessary to return her to "original condition". Shes on the right track but obviously scarred for life both physically and mentally. Its a rough road, but we found that a legal process just wasnt going to do anything. Mr. Hollywood is exactly correct.

tutela it takes years, I think she should be thankful she is alive. having plastic surgey is extremely risky and people die from it all the time and people dont get the picture. I bet you anything that she will probably will get something else done or just perfetc what the prevoius doctor did not get "right", people in colombia aren't too sharp about they are getting themselves into, especially those who go through these procedures. they only look at the end result and some of it is nice but u better be damn sure about what you are going to get urself into, you have no clue of what goes on in the operation room. your friend needs to be thankful.

Surf....... I'm curious as to why she did not demand anti-biotics immiediately upon contracting a fever. i'm no doctor, but a fever after surgery maybe translates into infection. She also should have gone into a cold shower immediately to lower that fever. She could have died. i had surgery in February that went wrong and I did the above when i had a fever. I've said it before, but I am from sea level altitude in Los Angeles and had my surgery at almost 9000 feet in bogota. Please be careful of the altitude change if this applies to anyone when getting surgery in Colombia.....IT DOES MAKE A DIFFERENCE IN RECOVERY AFTER SURGERY!

it happened in bucaramanga i'll post the name of the doctor as soon as i get it. they were running a promotion, so the price was very attractive at the time. also, is it true that you must pay the full amount before you can sue, she still owes the half...why pay the rest when then messed up? my friend told me you must do that in colombia, is it because its on credit? what do u recommend...should she pursue this or just forget about it?

Whatever else you decide to do, if you pay the butchers another centavo, you are throwing good money after bad. Definately do not pay, and definately investigate who the good guys are in Bucaramanga and see what they have to say about fixing things. Im glad im not considering any plastic surgery here anytime soon, cuz you folks have made a believer out of me. I would do dental work, as I did in Cali a few years ago and that worked out just fine, in terms of price and quality of work.

In Jersey City there was a Sting Operation "Bus Accident". People were running to get ON the bus after the 'accident'. The whole thing was filmed.

What do we think the % of lawsuits are that occur without merit? Bottom line is that many countries do not tolerate the "sue" mentality.

This forces the "buyer" in third wprld countries to be extra careful before jumping into anything. If there is a hole in the sidewalk - walk around it.

Anyway...

Life is too short to skimp on your health and the doctor you choose to assist with your health issues. Pay good money, do good research and bulk up on the antibiotics!

Surf - Sorry to hear about your friend. If she wants to sue she should have gone to a doctor in the US. This is a small part of the reason medical care costs are out of control in the US. An average surgeon pays well over six figures a year just for insurance. The US doctors are looking to cut corners when they are caring for you because they are making less than they used to.

One Good Way to Stop Medical Malpractice I have been to Colombia three times now for my medical and dental care and plan to go back this summer for an "executive check." The best (but never certain) way to prevent medical mishaps is to select GOOD doctors that perform surgery in GOOD clinics. Consider the savings you are getting in Colombia. It really doesn't cost that much more (if any) to go to a reputable clinic with a good doctor. In Colombia, they call those places "garages" where often unlicensed person practice medicine -- mostly cosmetic surgery. I have heard about them; however, I have NOT gone to Colombia for cosmetic surgery. Although, the same thing exists here in the USA. There are so-called medical professionals that botch procedures daily. Ask any doctor in Colombia (or the US for that matter) how many times he/she has done the procedure, how many times they have had complications, etc.... The clinics I have gone to in Colombia have had ZERO complications with the exception of one person who had high blood pressure (unrelated to the procedure being done) had to be treated. The company mentioned in another post www.firstcarecolombia.com is the greatest! I don’t want to pitch them here, but Dr. Soraya (a Colombian doctor) works with you and finds you the right kind of doctor for your needs and even coordinates with your family doctor They, by the way, saved me quite a bit of money on the surgery and dental care that I chose to have done coincidental with my travel to Colombia for other medical care. I couldn't beat their prices. In fact, I had been paying too much in the past and was at a disadvantage trying to deal with the doctors from the US. My message in short is: DO NOT try to cut corners in Colombia when the services are cheap enough with the finer clinics and surgeons!
