License for second civil wedding

The legal advance in many countries has created a special need to protect children in their physical and economic conditions. For that reason, many judicial laws and procedures were developed in order to protect their rights.

One of the custody’s institutions is called “License for second wedding�.

This procedure was born under the idea that if a person wanted to marry for a second time but he had children from a previous marriage, he was obligated to make an inventory of the assets that were owned by the children.

Since the year 2000, the Supreme Court declared that this law has to be applied for every one who desires to celebrate a civil wedding or wants to live in a common law marriage.

The purpose of this license is to establish a separation of community assets formed by the marriage (either civil or common law) and the patrimony of the children.

There are two ways to obtain the inventory. The first one is filing a petition in the family court. The judge’s decision will be to authorize or not the creation of the inventory, appointing at the same time a social worker who will check the truth of the inventory.

The second procedure is using the same notary which will be performing the wedding. In this case, the notary will go to the family court and follow the same procedure.

Experience has shown that the first way is easier because it provides time for the couple to get other documents in order. It’s important to know that most notaries don’t have the time to follow a process in court. Therefore, a lawyer is recommended to supervise the application for the license.

The legal consequence of not obtaining the license is the loss of rights in the event of death or in the case of divorce not knowing which property belongs to the couple.
