On my last trip no such requests were made. I was prepared with the information if needed but no questions were asked.

No such letter is required if the child entered Colombia as a tourist to begin with.

Call DAS at the departure airport if unsure.

my kids are colombian there father lives somewhere in colombia they dont hear from him very often wife wants to go to visit her mother but we are afraid that if we dont have this before we go the 2 kids might not be coming back he hasnt paid support for 4 years they dont receive anything from him only a phone call every 3 or 4 months

You can get into a mess. Better have your ducks in a row before you go.

Subject has been discussed before. Search this site and you might find helpful information.

The form letter from Gator is good and will work. However your problem seems to be more complicated. Do your kids have a US passport?

Gator says on Apr 21, 2008, 15:03:

DO NOT follow the above advice. GET THE LETTER WITH ALL THE i'S DOTTED AND THE t'S CROSSED.

Where was the divorce? If you have sole custody by a court order that will be accepted. But if it is the USA Court you will need an apostille. If it is a Colombian divorce with sole custody granted to you the same applies. If not and the father can not be located, a Colombian family court can grant custody which will be accepted by DAS "he hasnt paid support for 4 years they dont receive anything from him only a phone call every 3 or 4 months" will have no legal merit in Colombia with the exception, possibly, of the family court. The fact that he does maintain contact will weigh heavily against you in a Colombian court.

Better pay attention to Gator on this matter.

As I have indicated earlier my brother in law's wife could not even take their two boys out of Colombia to visit with their father who was working on his doctorate in Mexico. Got to the airport and was not allowed to board the plane.

They went back home. Father went to Colombian Embassy in Mexico City and had a notarized letter of permission faxed to the wife.

Gracis, aztec. ¡Exacto!

my wife never was married to the kids father just lived with him for a short time

vicshere says on Apr 22, 2008, 07:03:

yes but he is still the father...unless he was dead...then you just need to produce the death certificate

listo

Gator says on Apr 22, 2008, 08:01:

Makes no difference under Colombia law and the matter will have to be resolved in a Colombia family court.. If you have a problem with our information you should contact the nearest Colombian consulate and follow their advice.

Also, even if the children have dual citizenship, it is against the law for them to only use the US passport just so they can leave Colombia. A dual citizen has to go in with a Colombian passport and leave with the US passport. Those are the rules for having dual citizenship.

Also Gator sort of covered it but not exactly. The parent traveling with the child needs to have the official notarized document as well. His letter has the space for both but he does not specifically state that.

I know of many who have traveled with children and not had a problem, but I know of one lady who had to procure a document stating that she gave herself permission to take the child out of the country as well. It delayed her trip two days. CYA.

I always carry our marriage and divorce decrees and some of our immigrations paperwork as well. I have a jump drive that has a ton of info as well (credit cards, banking info, and other paper work).
