hello everyone
thank you for the good advise i always read on this forum.
my family wants to buy a house in SM. the issue we have is that if my father and mother save money to buy the house; is it true his older sons from a earlier marriage that live in Colombia may claim the properties as theirs.
we have not done any closing but would appreciate accurate information.
it doesnt make sense that a will is not followed in Colombia as it would in other countries

chock says on Apr 13, 2009, 08:29: In Colombia there are not inheritance freedom. that means you cannot distribute goods in the way you wish. inheritance law stablishes everything is going to compound a mass, which will be divided in 4 parts. 1/2 to legal heirs (children in or out the marriage) 1/4 to distribute to whom needs more from the legal heirs, and 1/4 for free decision. obviously, it has variations depending if there is wife, or not. In no willed cases, 4/4 is for legal heirs. but before,1/2 to survivor wife.
