You're all set. Just follow t You're all set. Just make sure that you've got English translations of anything in Spanish and follow the instructions. Once you get the I-797 back from the I-130 filing you can send off the I-129F for the K-3. That's a bit trickier because you're using a form that's meant for a fiancee and some of the stuff does not apply.

I recieved the I-797 about two weeks after sending in the initial I-130 last September. We started the K-3 (meaning the I-129F), but abandoned it since our CR-1 (which is really what you start when you file the I-130) was moving so quickly. It took about 7 months to get to my wife's interview at the embassy in Bogota, but our day there was short and sweet. We walked into the country on April 18, and I have to say the process really was a lot easier than I thought it would be, but those were a long 7 months.

You need the birth certificate to show that the petitioner is a US citizen. If naturalized, you need to include a copy of your naturalization certificate. You don't need the beneficiary's birth certificate if he/she is your spouse. You need these documents:

1) A copy of your marriage certificate.
2) If either you or your spouse were previously married,
submit copies of documents showing that all prior
marriages were legally terminated.
3) A passport-style color photo of yourself and a
passport-style color photo of your husband or wife,
taken within 30 days of the date of this petition. The
photos must have a white background and be glossy,
unretouched and not mounted. The dimensions of the
full frontal facial image should be about 1 inch from the
chin to top of the hair. Using pencil or felt pen, lightly
print the name (and Alien Registration Number, if
known) on the back of each photograph.
4) A completed and signed Form G-325A, Biographic
Information, for you and a Form G-325A for your
husband or wife. Except for your name and signature,
you do not have to repeat on the Form G-325A the
information given on your Form I-130 petition.

No birth certificate for him right now. When he actually applies for the visa at the embassy, then he will need his birth certificate.
