K1 visa TIME?????

How long do you have once you recieve the K1 VISA to impliment it and enter the states, I know when she enters the states you have 90 days, but my question is, when you recieve the K1 VISA, is there a certain time which you have to use it by or does it have to be used right away or it starts cutting into that 90 days.........

Generally speaking, once approved, your petition remains valid for four months. In the event that she does not enter the US in that period, the petition can be revalidated by either an INS district officer or a State Department consular officer for another four-month period, so long as the parties are still free to marry and intend to marry. A fairly straight forward process.

The 90-day time frame begins the moment her passport is stamped at the US port of entry. DO NOT EXCEED THE 90 DAYS IN AS MUCH AS NO EXTENSIONS ARE AVAILABLE.

Hey Bama, Gator is almost correct. You actually have 180 days from the date of issuance to the the last day your fiance can use the visa for a single entry into the US. That is roughly six months. I just looked at the visa in my wife's passport. It is dated February 23rd for the date of issuance, and has an expiration of August 20th. Of course, unless a rule has changed in the last 4 months, I know I am 100% accurate on this. By the way, the filing fees have skyrocketed since I went through the process, so anything can happen and maybe Gator gave you the latest info. But as of this last February, it was 180 days.

I will go with the 180 days, but here is what the foreign affairs manual at the embassy /in Bogotá states. I would be guided with what ever the visa placed in her passport states:


SUBJECT: NEW NON -IMMIGRANT 41.81(K) NOTES

SUMMARY: Attached are recently revised Notes to 22 CFR 41.81, incorporating the latest interpretive and procedural materials relating to not only K-1s and 2s, but the new K-3s and 4s.

Sec. 41.81 Interpretive Notes

N6.2 Validity of a K-1 Petition

An approved K-1 visa petition is valid for a period of 4 months from the date of USCIS action and may be revalidated by the consular officer any number of times for additional periods of 4 months from the date of revalidation provided the officer concludes that the petitioner and the beneficiary remain legally free to marry and continue to intend to marry each other within 90 days after the beneficiary''s admission into the United States. However, the longer the period of time since the filing of the petition, the more the consular officer must be concerned about the intentions of the couple, particularly the intentions of the petitioner in the United States. If the officer is not convinced that the U.S. citizen petitioner continues to intend to marry the beneficiary, the petition should be returned to the approving office of USCIS with an explanatory memorandum. [See Sec. 41.81 PN7 for revalidation procedure

N6.1 Action When Petition Received

Upon the receipt of an approved K-1 visa petition the post
should send a letter to the beneficiary outlining the steps
to be taken to apply for a visa. If the initial 4-month
validity of a petition has expired without a response to
the post's letter, the consular officer should send a
follow-up letter to the beneficiary, with a copy to the
petitioner, and request a reply within 60 days. If the 60-
day period passes without a response from either party or
if the response indicates that the couple no longer plans
marriage, the case is to be considered abandoned, the
petition is to be retained at the post for a period of one
year and then destroyed.]

I guess good advice now should be: "Officially, as written in government documents, the period is 4 months." "However, you may be given 6 months, but just don't plan or count on it being 180 days."

The petition, once approved, is valid for 4 months. The petition allows the beneficiary to apply for the K-1 visa. The K-1 visa itself is valid for six months from the date of issue.

Ok Gator ... looks like UC cleared things up. We were talking about different things. I was talking about the date of visa issuance to the expiration date. You were talking about the approval of the initial petition to the visa issuance date. Now it makes sense.

For those who are just now thinking of filing in the near future..... I mailed my 2 1/2 inch thick pile of organized paperwork to the USCIS a few weeks ago and just today received my first communication (other than the certified return receipt), received the Notice of Action... today... what is that, form number.....I-797C. Very official looking paper. How the F*Q do they come up with all these letters/numbers to label these forms??? jejee.. damned, I bet that would bore ya to death, if you/we knew the story behind that, eh?
