inviting in-law to USA - need advice concerning visa papers

My wife's sister wants to visit us in the US. She has applied for tourist visa (H1) and has the big interview scheduled in Bogota next week. I (the US citizen) was about to start putting an invitation letter together for her so she can show that at the interview. I was planning on providing her a place to stay while visiting us, but now I'm reading online that either she, or I, need PROVE how she will be supported. At the last minute here, I find out she doesn't have much to prove anything, not even a bank account. Then I ran across a web site suggesting I might need to do an I-134 affidavit of support for her (***what a pain***). Anybody gone through the tourist visa thing who can give me some feedback on this, err quickly :), and how best to put supporting documents together to have the best shot at a visa. Thanks

Not much you can do, She has to prove her case by herself, on her own merit. If she cannot Verify a Job, Bank acct history, Ownerhip of property in Col, she will probably be turned down. She has to demonstrate, in like 3 minutes to the Interviewer, why she will return to Colombia and not abandon her country and remain in the USA. Due to past Visa Absconders from Colombia in large numbers, this makes it hard for an Honest Person like your Sister in Law to secure a Visa.Good Luck

Problem # 1. H 1 is a work visa not a tourist visa so she needed a sponsoring employer who must file Form I-129 (Petition for Non-immigrant worker) and H supplement with the
Immigration office having jurisdiction over the place of employment. The filing fee
for an H-1 petition is $320. All employers must complete and file Form I-129W with
the Form I-129 petition. The filing fee for Form I-129W is $1,500 for employers with
25 or more employees or $750 for employers with less than 25 employees.

Problem # 2 "At the last minute here, I find out she doesn't have much to prove anything,
not even a bank account." I hate to be the bearer of bad news but as they say in
Texas, "Her chances are slim and non and Slim just left town."

Problem# 3. If your meant a B2 visa, which is a tourist visa then I hate to be the bearer of bad news but as they say in Texas, "Her chances are slim and non and Slim just left town."

Quite frankly the last time this type of request was granted three wise men and a star came out of the east.

Sorry, i mean B2 tourist visa.

This site (http://www.immihelp.com/visas/visitor/sponsordocs.html) talks about the affidavit of support. Has anybody else done one of these for a tourist visitor?

JohnD123, good luck guy. I don't want to beat a dead horse, but the rule for people in your sister in law's shoes is 2 out of a 100 get the visa.

Generally, to have a chance at a tourist visa for the US, the applicant needs to show substantial financial assets in Colombia, property owned in Colombia, close family ties staying in Colombia, current, gainful employment in Colombia, etc.

I don't think an affidavit of support would hurt - but I also don't think it will help much. Like a poster said above, the applicant must obtain the visa on their own merits. That is paraphrased from the "rule book."

I am serious though, good luck to you guys and I feel for you. I am married to a Colombiana, and we have to face the reality that we will never be able to share time with her family in the US.

I agree with everyone here. Good luck!
