Mr.Warlord,
Last Tuesday I went to the Colombian Consulate in Toronto, I was there getting divorce decree, marriage search and birth certificates certified for a friend. WHile I was there the only other guy who wasn't colombian was doing pretty much the same thing getting documents certified for marriage in colombia, except for some reason his fiancee's notario needed to have him certify his passport as well,....??? The consul was trying to explain that she's never certified a passport before. It seems pretty stupid having to have your internationally recognized passport certified .
I think in colombia the notario is legally responsible if he marries someone who's already married or isn't who he says he is. That's why the notario can be so demanding. My friend who has been divorced was asked by a notario to provide the marriage certfiicate as well as divorce decree, that's unecessary but one notario wanted it. It's possible that this "Inventario solemne de bienes de los menores" is something just the 5th notario wants and not something another notario would ask for.
Before you get into how to get that document make your girl go to at least two other notarios and ask them what you'll need to marry with them and you just might find a notario who isn't crazy. ...

Mr. Power,
Thanks for the chuckle - that last sentence in your response did it. That passaport thingy you mentioned, Notaria 5, he wants mine certified and apostilled also. A bit odd, but oh well.
Thanks for the advice - i'll have my chiquita go scout a couple more Notarias - maybe we'll get lucky.

Try a different notary. The requirements can and do vary. BUT, when you do choose one make SURE you have EXACTLY what that notary requires.

The inventario solemne, is a license that notaries and courts require for people who want to get married but have children of previous links or weddings
The purpose of this document is to separate the possible properties of the minor to the community of assets created by the marriage.
All notaries must require the document and the consequence of not asking for it, is that parents loose their right to inheritage their son.
The process to obtain the license is a petition to the court and after some declarations, the judge give the ok for the wedding

If anyone's interested?
When I went to the consulate last week I waited in line for 2 hours. They have a take a number system but every colombian who came in the office went straight to the front of the line and it really slowed things up. It was a horrid reminder of the waiting in line i've had to do since I met my wife. My friend has a divorce decree from a previous marriage and he needed that certified. When It was my turn the assistant consul took me into her office and explained to me how she couldn't certify the divorce decree because she couldn't recognize a seal from the province of British Colombia I had to go to a notary in the building and have him notarize the supreme court decree from BC??? Then I had to take a number and wait another 2 hours.
I later read on the wall there while I was waiting that they only certify society and legal documents (like the divorcee decree) after they have been notarized.
Marriage in colombia isn't easy there's a lot of hoops and hurdles you gotta jump through before you wed and that's just the start, wait till the visa process. But search through this site everything has been discussed over and over you cant go wrong here.
If your wife to be is looking for you to get the inventario solemne its because you have kids? Why not just omit that fact when you go to the next notario? He'll never know. Your not bringing them to the wedding? And if its because she has kids don't worry its her problem you focus on your papers let her struggle with hers its her country.

Tom : what you are telling to warl is to commit FRAUD. What are the consequences? well.., just a criminal case to the couple plus the loose of all rights of the mother of the kids.
Another stuff is that divorce is different to a license so it is not good to mix 2 different procedures.

Hey Esteban,
You're right don't listen to me what do I know?
I'm not a colombian lawyer or a colombian notary.
I can however shed some light on the reality of living and dealing with a colombian wife,...
My experience has been this, I did everything from the marriage to the visa and my wife was very little help. I did everything because she's a professional beggar. Now that we're living here in canada I'm still doing everything. Had I just backed off in the beginning and made her do everything she'd be a little more self-sufficient now. My advice is this..... don't work to hard at it. Let her do everything. Your wife should be at the poorbuthappy of colombians asking about how to get the Inventario solemne for you and spelling it out step by step.
If your wife wants this to work and is willing to do what is necessary for a life in USA the least she can do is manage what you gotta do to get her there, if she can't do that you'll be carrying her forever.
Don't get the wrong idea my wife is HOT but cripe it sure would be nice if she could do some of the work, the whole taking care of her has got out of hand and I know when it started,... when I negotiated the marriage ceremony with the priest in colombia. We showed up at the church and he didn't even know who she was. It's pretty hard to get her to do anything now after doing everything in colombia. She keeps telling me how its my country she's a stranger. Try using that on your wife.

yes, i understand your opinion, the idea is to not make more complicated the situation thinking that in the future there is the chance for a divorce or death and it would be extremly difficult to make the liquidation without the license
Excuse me if i ofended you, but pm in case you need something

Hey everyone who responded - thank you sincerely. I appreciate very much your recommendations and your time.
Here's where I am - My chiquita paid a visit to another Notaria with the same result - if she or I have minor children, which we do - then the Inventario Solemne bienes de los ninos is mandatory before marriage. Ok, she has hers, but I dont have mine and dont know how to get it. Being a US citizen, we have no such legal requirement within family law here.
Looks like i'll be retaining an attorney in Medellin to unf*ck this matter. This sucks.
Esteban, how much you gonna gouge me to resolve this thing?

When I married my wife, I had minor children and so did she. She had to do the whole inventory routine but I didn't have to do anything.
