In love and wanting to marry

Well, I have met the love of my life. She is Colombian, I am Texan, ok ok, American. Anyway, my girl's visitor visa expired before I met her. I have no idea if I am breaking the law by marrying her, it it puts either of us in any danger in regards to American laws. How do I marry her, just walk into the county courthouse and tell them what we are doing? Is it easier in Las Vegas? What is required? I really need some advise regarding this predicament. Thanks in advance.

Marriage laws vary from state to state You probably won't have any legal trouble marrying her. Be aware, however, that marrying her and BCIS letting her STAY here legaly are two entirely different animals. Marrying her won't mess up her US immigration status. Overstaying her visa WILL (and married to you or not, they CAN kick her out and/or ban her from returning, whether or not they will actually do so depends on a lot of factors). See the BCIS website for a list of their (rather complicated) regulations and/or consult an attorney who specializes in immigration cases.

Had a friend in a Similiar Situation who married a Colombian Woman and to make matters a little worse, as her Tourist Visa was expiring she went to Immigration here in Miami and asked for Political Asylum. They married like only 3 months after they met here and her immigration status, 3 years later, is still not resolved. She cannot travel out of the US until this is resolved. She is in Limbo and can still be deported. Question is , will she? Tough way to start a marriage and this guy is out at least $5,000 so far in attorney fees and that is not the end for the attorney $$$$.

In love and wanting to marry The first thing to do is find a competent immigration lawyer, in Houston there are many lawyers in this field, but many of them are shysters too. Good luck, I hope everything works out OK for you both. I also say I am a Texan first.

Then you met her and now you want to get married?

I don't want to question your feelings, but you should find some way to see if she really loves you or if she see's you as a way out of her current visa predicament.

I think getting sound legal advice would be the first step before even thinking about getting married--whether or not she's using you as her ticket to stay in the country.

Based on what you said, there are several "worst-case" scenarios and you, the gringo, are the loser in all of them:

1) she doesn't love you: you get married, she get's her visa sorted out, she divorces you and takes her visa and half your stuff and leaves.

2) she does love you: but marrying you doesn't immediately solve any visa issues. She gets sent back to Colombia while it all gets sorted out (which could take years)...Meanwhile, you're married to someone 3000 miles away and only get to see her a couple of times a year.

3) she does love you and everything works out just fine....maybe, but with the government involved, what are the chances of that happening?

Anyway, good luck out of your predicament.

You have two issues marriage requirements...which vary from location to location in the USA. The other issue seems to be that she has overstayed her visa. How long has she overstayed? Her immigration problems need to be addressed first.

Marriage is somewhat separated here; yet it can factor in. You need to speak to an immigration attorney SPECIALIZING in the facts specific to your case. Possibly you can get married and have her stay here...DON'T under any circumstances let her leave the country until you have made an intelligent INFORMED decesion on your path forward.
