IMPORTANT LEGALIZATION OF IRREGULAR FOREIGN VISITORS IN COLOMBIA NEW DEGREE

Good Morning all PBH members.

I received the legal magazine today and it showed a new degree 3970/08 that allows irregular visitors in Colombia to get legal status with DAS and MRE

the degree started on october 14/08 and lasts for 180 days. Time that the petitioner has to organize his legal situation and paying DAS the penalties.

The idea of the Gov is help all irregular people to get normal status.

Really though it's good. I'd love to tear down borders for people and I am grateful that Colombia lets me easily come and go as I please without much hassle even though my country does not offer Colombians the same courtesy.

All I have to say is it is not as good as it seems, a. Written application to DAS b. you must have been in the country prior to April 1, 2008, c. you file a considerable amount of paper work like copy of passport (All used pages) and passport must be valid for at least six months.work history, financial statements, education, present employment (financial and employment require notarized statements), martial status, police report and all of your activities since entering the country., d. DAS conducts an in depth investigation, that is turned over to MRE who may or may not issue a salvoconducto good for 90 days and e. last but not least MRE may or may not issue a visa depending on its investigation.

Its all kinda new at this point. So far 111 foreigners have applied for regularization of migration in Colombia in less than 15 days .Thirty-six Chinese, 25 Ecuadorians, 20 Cubans, 19 Peruvians and 11 foreigners of other nationalities as Costa Ricans, Syrians, Lebanese, Venezuelan and some Europeans. No USA or Canadians have applied to date.

It is my understanding this law was drafted to allow 'undesirable' foreigners a way of getting their wayward ducks in a row before leaving. I further understand there to be a SIGNIFICANT penalty in terms of being barred from re-entry: anywhere from ten years to life.

It's not useful to normal folks just looking to stay a little longer or get around obtaining a more appropriate longer term visa . . .

My take was a little different-it can lead to a visa after the salvoconducto is issued and the 90-day review is completed (Note this can be extended to four months.). In rereading 3970 I could find no "penalty"stated. However, decree 4000 provides for expulsion and denial of re entry to Colombia for periods of 6 months to 10 years-or it can be permanent.

However, you are correct in stating it is of little or no help to someone who overstays a "tourist" entry and just wants to hang around a little longer.

Dr. Rada, please comment if necessary. The law is still new and is, like any new law, subject to bureaucratic interpretation.
