I NEED VISA INFORMATION, JUST THE BEGINING.....

ok well i need alot of help....first of all hello to everyone, its been awhile that i havn´t gone on here, i moved to cali about a year and some ago and its great. i used this site to get a lot of information in what i need to do to get my dual citizenship and processes that i had to go through.....well again i NEED your HELP.....

well im now planning on getting married so i can move back to the states with my future wife and start a family. and i just started doing research in what i need to do so we can go....its kind of confussing, and i need some help and advice in what i need to do.... well heres the top question that i have and that i believe every asks.....

What is the fastest way to get a visa for my wife?
and
How long does it take?

well we´re not married yet, but i assume that its the 1st thing that we ought to do that would speed up the process. and from what i hear it takes like a year or more.....
ive read about the K1 & the K3 visa.....which is better? i know one is for fiance and the other is for spouse.....which is better in regards to regulations and time? my girl has a daughter so from what i read the K3 visa is for spouse and child.... which i assume its the one i need.....with that i need a

Form I-130 (Petition for Alien Relative)
Form I-129F (Petition for Alien Fiancé) ----> why is she´s my wife?

now my other questions......what, where and how do i get these? do i have to download them? or go to an office here in Cali, or go direct to Bogota to pick them up? how much do they cost? i hear total it costs around 2,000 dollars to get the visa with the lawyers doing all the runs for you, i would prefer the cheaper route but whatever it takes is the objective... i heard that it is necessary to pay with credit card for certain things right? thats not a problem but then payment will be in dollars right? i cant go to an office and pay with pesos right?

but now, this visa for for nonimmagrant status right? which means they have to then request to change there status once they arrive to the states in order form them to get there green cards and permenant residency right?

basically whats the general process in what im gonna have to go through?....break it down for me if you can...i know its only the beginning and i have to do a lot of research and work but i know you guys are real good help so i wanted to ask here 1st. thanks in advace and i will be replying and checking in as often as possible. thank you

I don't have a lot of time right now. But to answer one of your questions: The processing times for the K1 and K3 are darn near identical. Since you are already in Colombia, you might just try to go ahead and get married. Even though the Colombian marriage will add time on, when your wife gets her visa for the K3, she is almost immediately considered a permanent resident, can work, etc. in the US. A K1 saves you the marriage prep time, but then you have to file for adjustment of status after getting hitched in the US. In other words, she will get to the US faster, but then she'll be in a state of limbo for several months until the AOS is approved and she gets her permanent residency.

Question to the others about the same subject: Would it be easier and faster if I get all her paper work done in an immigration office in the states or would it be easier and faster if it is done in Bogota. We want to avoid the Bogota seen because of the long waiting and the long trip from Cartagena. What I am talking about is her Visa to the US once we are married to meet my family, etc and also to show her all over the US by visiting most points of interests.

It will likely be difficult to get a tourist visa for your wife. As strange as it seems, it might be easier to get a spouse immigrant visa. If you are a US citizen and reside in Colombia, you can inquire about Direct Consular Filing. In any case, you cannot avoid dealing with the embassy in Bogota.

I am not in Colombia now. Just got back last week. I am going back in two to three weeks to get married there. I am in Puerto Rico (same as US), and I was told by the colombia embassy here to go to US immigration office here in Puerto Rico and do the paperwork there. I was just wondering if it would be easier in Colombia. I am going to the US immigration office in a couple of days to ask questions. In the mean time I just started to fill out the forms for her just so I will be better prepared to understand their language.

I feel it may be much easier doing it from here because there are not much people there and no lines to wait, and hence, they will remember me when I go back for what ever may be needed. Besides, is only half hour away.

The only way to petition for a US spouse visa in Colombia is if you reside there. If you are marrying in Colombia, your only options are CR-1 or K-3 spouse visa. You could always try for just a tourist visa in Bogota, but the outcome would be unpredictable.

That is pretty predictable. Some more optimistic people will say I am way off, and that it is actually only a 95% chance of denial. But from different reliable sources, the info I have obtained put the approval rate at about 2 out of every 100 applicants - 2%.

Tourist visa is difficult your spouse will need ties to Colombia = prpoerty, good job or business, bank account with money, etc... The more ties the eaiser the visa. For Direct Consular Filing you both must want to live in the USA but you both currently reside in Colombia. This is the best option for you!

Be careful trying to use that tourist visa while your case is being processed. Many people are turned back when actually trying to enter the US on a tourist visa if they have another visa case pending. It seems to be hit or miss, but it does appear to happen with some frequency. You might even get lucky on one occasion. only to get put right back on a plane home on another.
