Colombia’s legal system orders that any kind of will has to respect the line of heritage, which is described in the civil code. This means that in example your son has the first right to obtain your assets after you die. Then your parents (could be only 1 or both), if they don’t exist, your brother obtains the right and in last place your nephews.
If you are all alone, the Colombia’s government through the Institute of National Welfare (ICBF) gets everything you have in Colombia.
I have had cases in my office, where American has made will in the United States but they have properties in Colombia too and think that their will made in US covers every aspect. THE TRUTH IS NOT. GOODS IN COLOMBIA CAN BE ONLY RULED BY COLOMBIA`S LAW, this also includes the structure of a will. The answer is to write a will for assets in Colombia, job that only can be made through lawyer.
