I HAVE A QUESTION REGARDING MILITARY STATUS....

'
Iam a Colombian citizen that came to the united states with a temporary visa when i was sixteen years old. I never went back to Colombia. I stayed in the states. My question is this: If I want to go back and live in Colombia with my american wife and kids, will I have problems when I go back because of not going back when I supposed to. What about my military card? I never got one. Can I take care of that with the consulate here in the states. It has been years, so Iam alittle confused as to the laws, and things. Any advice would help.

You'll need to give some more information. In general, Colombia doesn't give Colombians coming back a hard time, so it should be ok. Contact your Colombian consulate first, see what they say.

okay, my wife and i are married for over 7 years now and we are working on my paperwork in the states before i even go back to colombia. i was just worried about the libreta militar issue, and of course because my visa was expired..before i left colombia, I was 16 years old and i work at the batallion, is what they call it and they gave me permission to leave the country, which i had to have there permission before i could leave. Anyway, Iam now 31 years old with a wife and three girls, and am working on my paperwork in the states, but like i said wanted info on this issue if we decide to go live in colombia, which is what we are looking to do. But basically, would that still mean that i can not go back into us for maybe 10 years even with papers? thanks for all of you alls advice

Very good lawyers cost a lot, but can make the seemingly impossible happen sometimes. I would be scared to death in your shoes to go to Colombia - because of the re-entry into the US issue. 10 years is what Homeland Security says on it's forms. Life ban is possible. My advice is I would not try and tackle this myself, if I were you. You need an experienced, immigration attorney.

I am no expert on it, but like Peter says above, you shouldn't be hassled in Colombia at your port of entry. Even if you have to register for military service, you should be able to buy your way out of that. There are different prices for different circumstances. My wife's little brother doesn't have to serve in the military. When he was done with colegio, his mom payed a fee to keep him from being called to serve in the military. The official reason was he was the only male child in the family. Then, based on that and their estrato level, they had to pay a waiver fee. That was it. I am sure there is something like, "A 31 year old, married guy with 3 kids" provision. You will have to pay a waiver fee (I am making that term up), but you should be able to get out of having to serve. Again, good luck.

If you're married, you are already legally exempt from serving.

You may still, however, technically have to pay a compensation fee.

You won't have problem with the militayr for two reasons: 1) You're married. and 2) you're 31.

If you'd were under 28 (and not married) you would be detained and taken into military service for 1 1/2 year as a "remiso" for for evading the conscriptions. But because you're exempt from that if you want the military card you need to pay a compensation fee which would cost depending on your income level.

Actually you don't need the card but it could be a problem if you don't pay it after you have been requested to do it. Also if you want to work, you need to pay because most of the jobs will request it. Also, you'll need it for any kind of professional studies. And if you get into a police or military "reten" you'll be detained until they verify your status.

The US problem seems a big thing. Under what conditions you inmigrated to US ? asylum ? refugee ? remember that even though you'd be a legal resident, if you went under any of those 2 conditions you can't return to Colombia until you're a US citizen. You could be stopped at customs (many colombians have suffered this lately and mostly in january after christmas vacations) and could have your asylum/refuge cancelled and be deported to Colombia. Theorically as a resident you're free to go anywhere but i wouldn't play with USCIS
