I-751

do I need to fill out a 751 form for my wife and 2 other seperate forms for my 2 stepsons?now until the 30th of july its $200,,after the 30th it will be $500 each.hher expiration date of temp res is jan 24th 2008,,,can i file now???and not within the 90 days before the 24th jan?????

For the children you would include then in part five of the !-751 petition. Be SURE and include their "A" numbers. Seperate I-751 forms are not required.

I really do not know what the USCIS attitude will be in an attempt to beat the fee increase. I know the form says 90 days, as determined by the expiration date on her conditional card. I guess the worse thing that could happed is it would be returned.

You may end up having them keep your filing fee and denying your petition because it was not filed within the proper time frame. This has happened with people filing citizenship petitions too early so I can imagine the same thing happening with the I-751.
