I-134 Affidavit of Support

I'm self employed and haven't done my taxes in awhile :( I read that I could use other documents as outlined in "Information Sheet 2000" I can't locate that sheet on the State Department site, does anyone have the sheet? Anyone else been in this position?

It's from the UK Embassy, but a DS 2000 is a DS 2000.

I am only giving them what they ask for, nothing more. The instructions ask for 1 years' worth of taxes and a bank letter,that's all I'm giving them. In duplicate.

You can use the same I-134 for her and her children. You do not need a separate I-134 for each of them.

By the way, everything will be run through a national data base INCLUDING the IRS. If you get caught in a lie that's almost the end of the story. In addition the _1-134 is a SWORN affidavit that is legally binding. In this case, especially with a child involved, more is better.

1 year tax info may not be enough hey bobbyb I also just sent 1 year's tax returns to my fiancee but she called me in a panic cause the Bogota embassy asked her to provide 3 years of tax returns from me. I didn't want to argue and make her feel worse, so I fedexed the other 2 years - $55 for fast delivery!
So, if you think they are asking for too much info - they have all of that available to them and more - they are part of the US Govt. and to top it all of they are part of the Homeland security dept.
So, don't be fooled into thinking they don't have the info on you, they are just making sure you provide them good collaborating info or there may be delays.

Here's another question. They ask in number 7 for the address of my real estate, there's only room for 1 place, what if I own other property? Where do I put that? ( I should just send the deed to the IRS hehe!) Let's just stick with the questions for now, you've only answered one, thanks to the cowboy over there in the corner

yes they will deny petition... If you owe taxes, or have not filed they will deny the petition. As I said before, we had the same problem and had it fixed within a month, paid pennies on the debt and had filed evrything. If you want their info PM I will give you their contact.

I don't remember "1 year" I don't have the form in front of me, but I'm pretty sure I saw a requirement for "3 years" of tax returns & W-2's. I don't recall if that was from the embassy's list, the I-134 form or what. But at the interview, they looked at each and every one of the 3-yrs worth of forms. If they didn't want to see them, they would have shoved them under the glass like they did with about half of my application.

Do what you want, but if something is missing, it will be your fiance that will be the one leaving the interview window in tears (like I saw when I was at the embassy with my novia).

Remember, while it isn't quite as difficult as a tourist visa, the burden of proof is on you as the sponsor to prove you can support your "immigrant." If they can't check all the boxes on their form (and they have a checklist with squares on it for checking) then your application will be denied or at least postponed. And if you lie (whether by omission or false statement) they WILL remember you.

Better to get things straightened out here before bringing any more governmental attention to them.

But to your other question. if you have additional information that doesn't fit on the form, simply put "see attached" and then on a separate sheet of paper write: "Form I-134, Question X: blah, blah..." and make sure you have your name and your fiance's name and case number on that sheet in case it gets separated from the pile.

ok ok ok People, I'm not pulling the wool over anyones' eyes. I have always filed and paid. Taxes and death, no way around 'em. I'm late this time because my sister is my bookkeeper and she's been sick off and on for a while and I have to prop her up on her desk and tape the pen to her hand.
The concensus is 3 years returns, I'll send them, 1 years' bank statements, I'll send them. Whatever they need. The form and instructions say, quite clearly, 1 years' returns. My novia returned package 3 today. I would like to have the I-134 done while I'm waiting for my taxes to be finished, (The end of this week)If I owe I want to talk with Somanyquestions as he seems nearly like my situation. I now have 2 questions answered, I need one more answered.

They want to know "your" income Not your business's so it would be whatever you put on YOUR 1040. This may be complicated if you have been trying to reduce tax liability by not reporting a lot of income (or reporting a loss) even though you have been "making money."

One thing to consider is that it's not unusual for a business to request a filing extension (for whatever reason) so you might consider sending your tax returns from 2001,2&3 with a copy of your extension request for 2004 explaining that you are still in the process of filing your 2004 return (for whatever reason).

I'm not an accountant nor a lawyer, just another anonymous internet poster, so take my suggestions with a grain of salt.

thanks for the final answer I'll have the taxes done. I did take a loss in '02 I don't know how they will veiw that, since then I've rebounded and I'm back making money above the poverty level or 125% above. I also have a good inventory of personal property that I can list out for them if you think that's also a good idea, that's also in question #7.

somanyquestions I didn't receive anything in my PM. Maybe I don't know how to use that feature?

yo tambien I just talked to a tax lawyer. I gonna take his advise. He said: that I need to complete all the returns that i am missing (done this week) then go to the IRS office with 2 copies, have them stamp them as "Filed", keep one copy for yourself. That copy is sufficent for the embassy. The IRS will not start sending you collection letters for 90 days, then I can make an "Offer and compromise" with the IRS or set up a payment plan. Depends on your liability. Sometimes, if your libility is high, like yours, the best route would be the "Offer and compromise" and settle up with them pennies on the dollar. Somanyquestions gave me the guys number, and belive me I hate talking to lawyers, but the guy gave me an immediate solution to this situation. And after I start receiving the letters I'll hire him to do my "Offer and Compromise"
The other thing he said, which contradicts some of the responses here, is the embassy WILL NOT check your returns against the IRS data base, they don't have the time to do someone elses job, (Sounds about right to me) that doesn't mean you can submit false documents. The embassy only wants to see that you filed your returns, even if you owe taxes.
So Cam I think we're on the same page but I think you could have worked a better deal with the IRS. I hope I can. I still don't know what the damage is.
Other news, I checked my girls' Virtual Package #3 and their good and she sent them, today via FED-X. So I'm ready to start a new thread concerning Pre packet #4 questions. Stay tuned
