How Colombians Court establish alimony for children and partner?
When people have problem about the alimony to their partner and children, the Law has created a special process called “Establish, raise, disminution, an exoneration of alimony”.
For example, when the couple has agree some money but it is not regular, sometimes is more in one month and then is less, the individual who has the right to the alimony can ask to a Family Court to decide how much he or she has to receive from the partner.
As a lawyer, when you represent someone with the right to get the alimony, the case is based on how much money is spent and what is the real amount received, in consequence that the sum is not enough to cover the expenses.
On the contrary, when you are the defendant, you need to prove that your income is not sufficient to pay your life and the alimony.
For foreign citizens, is good to say that Colombia has signed numerous treaties with other countries, allowing to seize salaries through home courts, so living in a different nation is not a way to forget to pay the alimony.
The procedure of this type of cases is one of the fastest in Colombian, and the judge in less than 2 months can decide, and the procedure does not give the change to appeal.
