Here's one guy that doesn't need to watch novela's

Hi all, This is more a question about Immigration Fraud. For starters, I would like to let you know that I personally am AGAINST any type of fraud, especially those that have to do with defrauding the USA. With that being said, here is the issue.
My best friend (let's call him “Jack”) American born citizen
And his ex-girlfreind (Lets call her "JILL") American born citizen
Have one 6 year old daughter together.
(Let's call her "Elle"). American born citizen
Jack and JILL Dated for 15 years. They NEVER got married together.

About seven years into the relationship, Jack and JILL split up for 3 and a half months. Here is where the story gets a ‘lil tricky. After their three and a half month break-up, JILL Divulges to Jack, that during their teeny tiny three and a half month break up, She got Married to Colombian born Citizen (let'z call him PACO). WHY? For the all mighty dollar. JILL told jack that Paco paid her $5,000 USD to marry her to get "papers" to be able to live, work, and whatever else the USA has to offer.

Needless to say, (however I will) Jack was not a happy camper. You see, It was Always Jack's Intention to Marry Jill. But he loved his girlfriend Very much. So Jack forgave JILL.
They got back together, lived together, and had a child a year later, Elle.
Jack and Jill loved Elle very much, Jack worked, and brought home the bacon and Jill stayed home with Elle. Everything was good until Jill started to control Elle, and making unreasonable demands to Jack
I.e. Make ALOT more money, Did not allow Jack to raise Elle, (even hug Elle). Did not leave Jack alone with Elle. JILL blamed Jack for EVERYTHING. INCLUDING HER MARRIAGE TO PACO!!
Needless to say, (but I will anyhow) Their relationship ended and Jill left with Elle. One year after their breakup, to add insult to injury, JILL Serves Jack with Custody papers (for Elle.) He goes to court, gets a DNA test and find's out he IS % 99.9999 Jill’s father. Ok cool, He's the daddy, break out the cigar's. However, during that time, JILL filled out a restraining order against him not to be around Her OR his own daughter Elle. Not only that, She does not even want give Jack VISITATION to see his own daughter. Only SUPERVISED visitations. You are all probably asking “…Is Jack a rapist, murder drug user, pedophile, etc.?” The answer is NO to all the above, He is a really nice, fair, good hearted, hard working man who loves his daughter Elle like nuts!
But here is his down fall. He is an American male father, which is not the best thing to be during a custody/visitation dispute in the state of California. Heck in ALL the States. Women by far have the upper hand in these types of cases.
The ONLY reason JILL is putting Jack through the grinder is cause Jack never married her. Jill was bitter because she felt like a single MOM. But, here’s the kicker, It would have been IMPOSSIBLE for Jack to marry Jill, cause Jill was married to Paco the Entire time that they got back together.
Please keep this in mind when you give your comment(s) question(s) etc.
Let’s talk about Elle for a sec.
Jill KNOWS that Jack is a GREAT dad.
Jill KNOWS that Jack would lay in traffic for his daughter.
Jill KNOWS that Jack would NEVER EVER hurt his daughter in any way.
Jill KNOWS that Jack would be very reasonable as far as Visitation is concerned.
Now that you got the HIGHLY edited version (LOL), Here is the question.
Knowing that Jill committed Marriage fraud:

Jack lived with Jill the ENTIRE time they were together (in other words, she told immigration she lived with Paco for “years”) Big ole lie.
Does any one know now anything about marriage fraud penalties?
Would it be hard for Jack to prove?
Do you think Jack can influence Jill in anyway to drop this charade.

I told Jack to stick it to her. But he doesn’t want Jill to go to Jail, or pay a fine. But, He does wanna be with his daughter. He wishes his ex-girlfriend the best.

Those of you who think Jack financially benefited from this Think again. His ex-girlfriend Jill had a serious fast food fetish. Whole lotta happy meals

Update on Paco: Received his paper's, He divorced Jill ‘bout a year ago and re-married (this time for real). I am happy for him he was a nice guy.

Update on Jack: Waiting Custody trial in 4 months. Jack has since moved on He is very happy. His hot new Colombian Girl half his age…and half his ex-girlfriend’s weight is making sure he stay’s happy!!! lolololololololol

Update on Jill: Gaining lotta weight. Has control of Elle.

Update on Elle: Cute kid without her father.

But your post (this thread) is great fodder and I'll add to the novella. Howabout Jack hiring a slimy private investigator with a hot secretary who is the PI's lover. The PI is hired by Jack to act as a 3rd party in order to blackmail Jose and Jill without Jack having to do it himself and then Jack has a affair with the PI's lover and the PI finds out and blackmails Jack by threatening to expose him to all - including the child!

Jack does need to blow the whistle on Jill. During the ensuing investigation, regardless of the outcome, the murkiness and suspicion could be enough to balance the tables a little bit when the Custody hearing comes up. He can get the Restraining Order set aside. In California, a woman can go into court ex- parte and say "Oh, my Ex is a monster and I'm scared for my safety and my child's safety" and a TRO will be issued no questions asked. HOWEVER, upon issuance, a hearing date would have been set, Jack would have been served, and would have had to show up on said date. At the Restraining Order hearing, Jill has a little more burden on her to prove the Restraining Order is warranted. A judge isn't going to give her a Restraining Order without something tangible to point to... even in California. Been there, bro. The problem is that if Jack gets stopped by a police officer for say... driving 40 in a 35... the fact that he's got a Restraining Order against him puts you in a totally different category. He can be searched and otherwise fucked with because he is already understood to be a "problem". After all, a judge granted a Restraining Order against him. So my first advice is to do something about that. If Jack tricked off his hearing date on the Restraining Order, then he has no one to blame but himself. If he wasn't properly served, then he still has hope. On the Custody issue, he needs to get down to Immigration and start telling all he knows. It will be easy to prove the fraud since he ought to have some record that Jill was in fact living with him and that with 99.999% accuracy Jill gave birth to his child during a time when she was supposedly madly in love with Paco. Jill ought to be toast. Jack needs to keep in mind that he's doing this for his daughter. This is no time for him to get soft and sensitive, given that Jill clearly doesn't give a fuck about him. He should slam Jill and save his little girl, or forever hold his peace.
