CIRCULAR EXTERNA NUMERO 0032
The Social Protection Secretary degree 205/03, establishes which people are exempt from paying into the Colombian pension program. This law also applies to foreign pensioners who are living in Colombia and are required to contribute to the Colombian Pension program when they apply for the Colombian health insurance ( EPS).
To determine for what type of cases the rule applies too, it is important to know the two different social security systems available in Colombia.
1. En el Régimen de Prima Media con Prestación Definida ( in charge of ISS, institute of social security):
Article 2 of the degree 758/90: People exempt from paying into the Colombian Social Security program. (pension)
a) Employee workers who register for the first time and are over 60 years old.
b) Independent workers who register for the first time and are over 55 years of age are exempt from paying into the pension program. (women are exempt at age50)
2.En el Régimen de Ahorro Individual con Solidaridad:
Colombian law 100/93 describes which people are exempt:
a) Pensioners from the Institute of social security or any fund of the public sector.
b) Men who were 55 years old or women who were 50 years old at the moment when the new system started (1993).
Note: For people who decide to contribute to the Colombian pension plan and who are exempt are required to pay into the pension plan for a minimum 500 weeks.
If you are in one of the conditions described above, you have only to pay health ( EPS) and professional risk ( degree 758/90 y article 61 of the law 1993). Professional risk is described as anyone working in a risky profession in Colombia.

BAQ says on Aug 3, 2007, 11:05: OK, here is food for thought. I THINK, am not sure but I THINK, once you have paid into the system for 1 or 2 years, IF you become disabled, you are entitled to collect what amounts to the U.S. version of social security disability. Semper Fidelis ! |
