Fiance Visa Question: The fiancees decide NOT to marry within the 90 days, she

returns home to Colombia as agreed. Per IMBRA, he is entitled to 3 Approved K-1 visas, but is there any time restriction or quantity restrictions for her as well? Does she have to wait X amount of time before being named in a fiance visa application for a different person, and is she restricted as to how many times she can be the "co-applicant"?

The colombiana told my friend that she is not eligible for another 10 years, as told to her by a Colombian lawyer......I know that if the US deports you, you cant even apply for a minimum of 10 years...but i was not aware of it applying to K-1 visas....

Any clues???

After your petition is approved, your fiancee must obtain a visa issued at a U.S. Embassy or consulate abroad. Your fiancee must remain unmarried until the arrival of the fiancee in the U.S. The marriage must take place within 90 days of your fiancee entering the United States. If the marriage does not take place within 90 days or your fiancee marries someone other than you (the U.S. citizen filing the petition), your fiancee will be required to leave the United States.

Please note that your fiancee may enter the United States only one time with a fiancee visa. If your fiancee leaves the country before you are married, your fiancee may not be allowed back into the United States without a new visa.

Dan, do you know if since this K-1 visa did not work out for her (colombiana) this time, can she enter the US again on a different US citizens K-1 visa application? or does this colombiana only get 1 shot at a K-1 visa for the US?

It Is My Understanding... embassy personnel, at least in Bogotá, would look on this as "visa shopping." Best bet is to contact the USCIS as famsearch suggests

one would hate to think so, since things could go sour for just about any or no reason at all. but it would look mighty suspicious, even to me, if one were to re-apply for the visa a week or two after one got back to colombia. best bet, check with uscis.

The Colombiana told me that a Colombian lawyer had informed her that if my friend and her did not marry, US immigration law says that she can not come over for another 10 years on a K-1 visa, which doesnt seem right to me. I think that she will be a little "gun-shy" about doing it again so soon, because they had been in a relationship for several years and it just didnt work out. She is a very conservative 35 year old with 2 kids, so i think it really hit her hard.

Just my opinion...
