Divorcing from colombian marriage.

Hi, well my question is as follows. I got married in colombia almost 11 years from now and things came to a halt. Well we have been living together but seperated about a year now. I have told my wife that we should get a divorce and move on. Well she told me that I am stuck with her cause she will not give me a divorce. She has made my life really hard. I dont want to kicj her out the door cause she is threatening to take our two boys. I was asked if I registered my marriage from colombia here in the us. When I said no, I was told that my marriage isnt legal here. She said that she will never give me the satisfaction of giving me a divorce. Can i go to colombia and divorce myself:( Does anyone no what I should do?

no, it is legal having gone through the process of getting married in colombia myself, i know that my marriage is legal and binding in colombia, the u.s., and in the eyes of the church.

It is legal everywhere! Despite the fact, you did not register it in USA. Therefore, you cannot kick her out from home, but what she can do is to register the marriage in the USA, then get divorce, then kick you out from the house and then to get a monthly benefit for the children!, if she does that, she will really make your life very hard. Then she will find a nice guy to get married, who will take care of her and probably to take care of your children as well, and will kick your ass if you try to do something against of her!. How ever, I like the joke..."Can i go to Colombia and divorce myself?".

If she leaves the USA with the children and takes up residence in Colombia you WILL likely have custody issues. The Hague Convention regarding this problem, has been signed by both the USA and Colombia.
You have some protections to prevent this from happening but you really need to consult a divorce attorney NOW.

No one will question her boarding a plane with the kids. Gator is talking about the problem's the OP will have once she's landed in Colombia with them.

So physically yes, she can leave the country with the kids. Legally, she cannot once the divorce papers have been filed and the section on custody limits her travel. If he's still married and hasn't filed anything at all, then he's got issues, because there's no order that restricts her from doing so. She could go to the moon with the kids and he'd have no recourse because there's been no discussion of custody so far.

cam... both parents have to sign off on permission for a minor to leave the united states. this happened with my niece, when my sis in law took her to colombia for a graduation present. since she was still a minor, both my sister and her husband had to accompany her to the airport.

Do you live in a No Fault State? In Florida where I live, you simply file, you don't need reason! I divorced my Wife this way in 1991 in Florida! My Buddy filed divorce papers(2 years ago) to divorce his Colombian wife after 15 months and in 3-4 months, it was permenent! He flipped her $5K, she grabbed it and she(and her two minor sons) were out of the house!

That's interesting Famsearch, because of the way some women play ball these days. There's nothing to stop the woman from taking her son/daughter to the airport and saying the father is estranged. She won't be forced to come up with a father's signature if she's saying the father left them years ago. At the federal and the state level, they just let her go (or sign up for services) and then leave it up to you to prove that she lied. Unless I misunderstood your post, the difference could be that it sounds like your niece was leaving the country with neither parent nor legal guardian. If your sister in law was merely acting as a chaperone for the trip, it would make sense that she drew greater scrutiny.

DIVORCE Well, in my legal opinion you are wasting some important time to get her guilty of divorce. Because you got married in Colombia and I imagine it was in notary, it doesnt have effect in USA but if you got her a visa, now the marriage does.

What do i recommend you? get a lawyer in Colombia and initiate the process inmediality. You need Try to avoid you declaration of guilty.

Remember kids custody, the obligation of giving food for life to the person who was declared guilty.

Since When??????? In general, marriages which are legally performed and valid abroad are also legally valid in the United States. The marriage is LEGEL in the USA as long as on as it adheres to the laws of the country where the marriage is performed.

Please cite your case law.
