Divorce case Between a Gringo and a Colombian, need some consejo

Since I seem to be the token Colombian amongst my circle, I get the oddest requests.

I met an american who was married at the notary in Cali 12 years ago, and then flew to the US and was married in a civil service.

If a divorce is to take place do you need to do it only in Colombia? Or in the US. Can you do it in one country and have it valid for both? Which country would be easiest?

From what I gather the guys wife is a US citizen as well, and he is a permanent resident in Colombia.

Any body got any ideas?

I know a few of you have been through this.

The lawyer I deal with here in Bogota said he can do a divorce in 30min if both agree and no kids involved.

Interesting question. So the guy was married twice? In both countries? What if there is only the colombian marriage?

I wouldn’t think it matters that he was married in both. If you are only married in one it is still recognized in both. I would think a divorce in one would still be recognized in the other. Just a matter of which is easiest.

Interesting question above. If he married in Colombia and then in U.S. I would think he would have to get divorced in both countries. Especially if he ever re married or wanted to travel to u.s. with novia or wife. joe

A divorce in the US is valid anywhere. If he ever meets up with another lady, he just has to show proof that he was divorced.

No advice here, only condolences. Should have got married only in Colombia. Keep your marriage in Colombia, your money elsewhere.

David yAmiga Sure the marriage would be recognized in both, if mariage was only in Colombia, IF she could get into the US without your support, IF she could speak english well enough, IF she had any idea where your assets were, IF she could find a lawyer dumb enough to go after some transient Expatriado with unknown assets, IF you gave full disclosure. If you keep it so that all of the above are resounding NOs, you have nothing to worry about, and it´s better than a Pre-Nup written in Blood.

What part does the Church in Colombia play in this divorce?

In this case, he got legally married in both countries, so he has to technically get divorced in both countries. However, he could technically get divorced in either country and probably use the proof of divorce to nullify his marriage in the other country. Think about it this way: if he got married in one country, he would still have to prove his marriage in the other. Thus, divorce works the same way.

Also, as aztec mentions, if they got married through the church, they have to divorce through the Catholic church as well.
