Constitutional Court rules against Forestry Law

The recent Forestry Law, which intended to allow and regulate the exploitation of natural forests, had been criticized by indigenous, Afro-Colombian and environmentalist groups.

Some of the critics considered that the law could have allowed paramilitaries (and others, I imagine) to legalize illegally obtained land.

The Court ruled that the entire Law cannot be applied, because it was approved without consulting (not at all or not enough?) indigenous and black communities.

Corte Constitucional tumbó la Ley Forestal

La Sala Plena del alto tribunal consideró que la norma, criticada en su momento por permitir la explotación de bosques naturales, se aprobó sin consultar a comunidades afrodescendientes e indígenas.

La disposición, ley 1021 de 2006, que fue impulsada por el Gobierno, fue criticada también con el argumento de que le daba la oportunidad a los paramilitares de legalizar las tierras de las que se habían apoderado.

Sobre el tema, el procurador, Edgardo Maya, dijo cuando la ley fue aprobada que con la ley, el país presenciaría "la explotación incontrolada y desbordada de nuestros recursos forestales".

EL TIEMPO conoció que la declaración de inexequibilidad afecta a toda la ley y la excluye del ordenamiento jurídico.
