I just sent out my I-130 along with my G-325a to Texas to begin the K3 visa process. What I am confused about is when I hear that you don't have to file for a K3 in order to bring your spousse to the states. Maybe I am just getting confused with the terminology. I know after I get the receipt from Texas with the NOA1 I can then send out my I-129f application to Chicago. According to USCIS person I spoke to he told me that Texas will notify me within 30 days. Then I send the I-129f with the fc-029 another g-325a and a copy of the NOA1 to Chicago which sends it to Missouri which is proccessing it at an average of a month and a half. He then told me during that time they will contact my wife in Colombia explaining what it is that she needs to do. Does this sound accurate, the guy basically told me that my wife could be in the States in about 2 or 3 months. Am I missing anything.

It cost nearly $200 more but it is worth because it seems like I-130 are taking a lot of time now. I did not file an 129f (k-3) and if I had it would have saved me nearly $5000.00. I sent mine in March and my wifes CR-1 interview is this month. K-3's sent in March were receiving interviews in September...since September, I have had to visit my wife twice for three weeks...losing two weeks pay and paying for two flights from the west coast.

ElCheAmericano says on Dec 16, 2005, 11:25: I know my question itself is confusing Well basically once I get the NOA1 I will apply for the I-129F. The USCIS person told me that once that is approved, which will be in aproximately a month and a half my wife can then come to the states and just wait while the I-130 is still being processed. He told me the I-130 are now being taking about 6 months time.

utopiacowboy says on Dec 16, 2005, 12:15: The information which you received about the K3 is correct. And, yes, you don't need to file for a K3 at all. You could wait until the I-130 is approved and then go through the process to get a CR1 immigrant visa. The only problem is this takes longer. The K3 is relatively quick and allows her to get her faster while you wait for the I-130 to be approved. Then she can AOS. Are you saying that once the I-130 is sent out & is received - I will get a NOA1. I then complete the NOA1 & an I-129F. The I-129F can be approved in 6 weeks and then I can bring my wife to the US immediately after I-129F approval & wait on the I-130 to be approved? 6 weeks seems a lot faster than going k3. Or am I missing something? I just started my process last week and mailed I-130, G-325a & I-864 (along with wedding certificate, birth certificates, passport photos, banking info, w-2's/1040's for 3 years). Is this correct?

utopiacowboy says on Dec 17, 2005, 22:57: Here is the source of your misunderstanding. The I-130 leads to a CR1 or CR6 immigrant visa. The I-129F leads to a K-3 (spouse) or a K-1 (fiancee).
