Colombians, Spain and Deportations

The mother of a Colombian friend is one of the many Colombians who traveled to Spain, found work, and stayed illegally (in this case for 9 years). She has two sons who were born in Spain. Apparently, Spain is now cracking down on illegal immigrants because of the recession. This woman is being detained, and deportation proceedings have begun.

Does anyone know what the odds are of successfully fighting against the deportation action? Will the fact that her sons were born in Spain have any bearing? How badly will Colombia be affected if thousands who worked abroad (and sent home money) are simultaneously deported back to Colombia?

That's a tough one. I've never lived in Span and I'm also not too familiar with their laws but I find it hard to think that the Spanish government would keep her if her children were born in Spain. She's still illegal and she doesn't have any authority to stay there.

As for the financial consequences on Colombia, it's a sure thing that it will be greatly affected. It's currently happening in Mexico with all the deportations being done by the US.

Spain is drastically stepping up Deportations of Illegals due to the Downturn of their economy. One cannot blame them as they want to preserve jobs for citizens and legal residents who pay taxes to maintain the country. The only Nationality to get a big break recently in Spain are Cubans (in spain as well are for cubans residing in Venezuela, Colombia, USA). If they can prove spanish heritage from their Grandparents, they will be in line automatically for Spanish Citizenship and to be able to live legally in Spain with the Blessings of the Government. Due to the dire employment situation in Spain nowdays, its Citizens are none to happy with this latest decree for the Cubans, which short term(and maybe longterm) will dump many new recipients on its welfare line and on the public Dole/tit.

I the mother is not married then the kids may be classes as Colombian not Spanish, it also depend if the father is Sanish or Clombian.
I think now all countries in Erope apply the same law to unmarried mothers I know Ieland changed their laws a few years ago as this was a way of staying in the country.
her best bet is not to fight on the grounds of been Sanish or Colombian but under the European human rights.also how old are the kids if they are school going then maybe the school can help you.

Here in Miami, they have had a lot of Deportations recently and it did NOT matter whether the Kids who were born here were US Citizens or Not. Immigration, its their viewpoint, they can take the Kids back home with them so the family is not broken up. Not sure how much of the Kids will have an affect in Spain.

Yes, it appears grim and the whole family is in an uproar. The mother has been sending money home from Spain for years to support her 2 daughters back in Colombia. If she has to return to the grandmothers crowded house in Colombia, without a job, there will be 3 more mouths to feed out of a reduced income.

I had the situation about immigration affect me personally in the USA. My wife is waiting legally to get to the USA and my former wife is allowed to stay here despite her lying to the US government!
