Is it true that children age 10 and above can choose which parent (post divorce obviously) they want to live with and the parent seeking custody petitions at the bienestar familiar?

lawyer CO says on Jan 2, 2007, 11:36: Advice Children who are over 14 years old can be questioned on Family Court without the presence of the family`s defender. However, on your case, the judge and the family defender are going to ask him several matters such as Why the divorce happened? who was better parent? with whom he would like to live BUT THE FINAL DECISION IS MADE BY THE JUDGE!!!!.

jnlondon says on Jan 2, 2007, 14:43: My spanish is bad, so maybe I missunderstood her, but her 14 year old said he wanted to live with dad and so dad petitioned with bienestar and got custody. Then she told me she could loose custody of her 9 year old the same way once he turned 10. Maybe I didn't understand her or she was wrong.
