Carls finally in colombia

Hi guys

I´m finally here in pereira. Been here for a few months now and what a beautiful country. Well guys I´m also having a bit of a hard time here. Things ain´t quite working out with my wifey. have a little baby girl and it looks like we are going to split up. She wants to anyhow. I seriously need advice about where I stand with what we own in colombia. what are my rights as a foriegner? Should I be entitled to half of what we own here in colombia. ( if not then it would be hard cause I worked hard for most of what we own.) Can I own property in my name etc. I am not saying my wifey intends to keep everything. But we have¨nt really been getting along too well. By the way I have a 2 year married visa. Where do I stand? Also is there anyone who lives in pereira. I am starved of people who speak english. I am trying to learn spanish and my spanish is not really too bad - slightly embarrassing though. Anyway having a slightly rough time. So help!!help!!! Help!!!!

A seriously confused and slightly alone carl.

Well, I am assuming you have a K3 visa. She has more rights, obviously, if she has passed the two year threshhold. Has she done her adjustment of status (AOS) yet? I have no idea where she is in the immigration process...

From my understanding, its pretty complicated to own something free and clear in Colombia when you are still married. You are going to have to wait until that process is adjudicated. Do you really want to stay in Pereira after this is over? So that you have visitation rights? She doesn't want to live in the US?

Is she divorcing you so she move to the US and stay their permanently with your partial support, or does she merely want half your stuff here in Colombia? How well protected are your US assets? Does she already have a lawyer, or is this just a threat?

I live in Armenia, about 45 minutes to the south. If you need someone to talk to, you can come down here and we can hang out. I have a couple of other American friends that teach with me, and there are quite a few Colombians, Peruanos, etc., that speak English.

You have to hire an attorney.
Anything that you bought after marriage is 50%. Don't worry, she cannot sell anything, even if it is put at her name, without your signature.
You will have to sign together a "licuidation de sociedad coniugal" at the notaria, in which you decide about the property of anything you own together, pay for taxes and rights, like if it is a normal sell of property.
From the moment you sign, properties will be free and anything you'll buy is your own.
