I don't even know where to start...
I guess the best way to start is by intruducing myself, right ?
I'm Ale, borned years ago in Mi Bogota Colombia.
Anyway 5 years ago my family recieved a letter from the Guerrilla saying that we must pay $30 millions (pesos) monthly or our lives would be in danger. At first we did not believe but after a month we started noticing some weird behavior around our house in Santa Barbara, one morning before I took the bus to school, I looked through the window and saw two guys in a motorcycle just across the street from my house, I told my dad about them and left to school, when I came back my dad told me to becareful because it looked like the guys were talking pics of myself. A week later after we recieved another letter, this time saying "We know about your kids, we know what the do, and where they study, we know everything about your family, you better start paying or you'll fucked you up"
After recieving this letter, we packed and moved to United States.
Long story short (I might write a book about it)
My family applyed for the Business visa, but when I turned 21 I got kicked out of it, so my mom had put me under the International student visa which means I cannot work, I have to pay a load crap of money for school, and I do not recieve any sort of benefit whatsoever in other words the WORST visa ever.
Everything was working out just fine, till we decided to moved to a different state. Before we moved a called the Community college to ask them if it was possible to transfer my student visa from FL to WI, the mexican who helped told me that it was okay [quote] Stop by to my office before July 2? and I'll help you will all the paper work[/quote] well as soon as I arrived to WI I went over to his office to start the paper work, WELL this guy forgot about the deadline and screwed me big time, there was no way I was going to be able to go back to FL, so I called the int student office explained them my situation and they told me that as long as I'm studying I'd be fine, [quote] Make sure to be full time student, pay int student tuiton, and send me all the paper to fl and I'll make sure you don't lose your legal status[/quote] Everything was "working out" by then.
This semester I started working/doing all the paper work to transfer my visa from FL to WI, everything seemed alright till they found out that I had an internation student visa from another state which obviously I was not attending to, after a long meeting with the person who works with int student she told me [quote] You cannot apply/recieve the International student visa[/quote] In other words I was "becoming" illegal
The office where we were was located in the 4 floor ! I wanted to jump out of the window, I could not believe that after all the thing that my family has gone through to pay my school tuiton, keep me legal in USA, and all so on , I was turning illegal.
I cannot not tell that to my mom, she will honestely die from a heart attack. I was lost didn't know what to do, didn't find a reason to keep fighting, to keep living, I wanted to put an end to all this suffering, I just wanted to die ! :(
Well no everthing in my life could be bad !
After talking to a really close friend about this whole situation she offered me to to married her [quote] why don't we get married, that would solve all your problems wouldn't it ? [/quote]
I never really though about getting married, so I need some help some advice, PLEASE GUIDE ME !!
Should I get married with her ? How hard would it be to get the papers, and fix my legal status? What's the process?
Please I beg you all for some help ! This is my last option, if this does not work I'll just give up with everything !

Perhaps you speak from experience maybe - who knows, regardless, an attorney is the best protocol to follow - not blatant disrespect for immigration law. I surely have to follow immigration laws when my Visa expires in Colombia, and, I do not go out looking for a Colombiana to marry for papers to stay in Colombia to avoid DAS making me fill-out paperwork. Of course I say this with highest respect for your opinion as akward as I may find it.

joser says on Dec 2, 2004, 08:25: wrong way If you get married you will still have to leave the country, have to go back to colombia and expect approval of your visa, or resident alien. There is a catch 22, if you don't get approved you will not be allowed back in the states for 10 yrs. Remember, in order to prove you are really married you must provide proof, that is lease agreement with both your name, life insurance with her name as beneficiary, checking account, and you will be subject to a separate interview, which will determine if you are really a couple or not. I would consult an attorney about another option before going through with this pllan.

No, I don't speak from experience because I have never been married nor would I accept that kind of proposal, I consider marriage to be sacred. However, I have seen how a marriage of this kind has ended up in a suicide.

And another thing at the beginning she used to live in Orlando and her application was a long way back, then she move with her husband for jobs reason to Kentuky and all the paper work pass to that state and is faster I don't know why, she said maybe is less people applying there. I will talk to her tonite and i will tell u have u got and email?

joser says on Dec 2, 2004, 12:17: change of status Kat 1 mentions that her sister was able to fix her papers several years ago, and she probably did it while we had an immigration provition called the 495 change of status. During that time you could pay a fine and process all of your paperwork here in the usa, and they gave you a interim card while your paperwork was reviewed. That provision expired about 2 years ago, and due to the fact that while it affected a lot of hispanics, and our poor show of political representation it has not been revived and probably never will. Again, as I stated above if you get married, your wife will have to apply for your recidency, but when the time comes for you to go for your appointment, you will have to go to colombia. If you go that route, I suggest you start living with your friend and really pretend that you are married, I mean everything because if they suspect that you are not, then they will not approve it, and you will be banned from the us for up to ten years.

Mr. Hollywood says on Dec 2, 2004, 12:19: Simple solution Why don't contact an immigration lawyer pay them to figure what the situation will be like for you and your true love who want to get married. Be totally honest about your own visa situation but do NOT tell a lawyer that you want to get married for any reason other than true love. If you do, it will put them in an ethical conflict and any decent lawyer will tell you to take a hike.
