As a tourist am I considered as legal domiciled in Colombia?

The general presumption of the law is that a domicile is the place where the person stays, lives and has his main business. However, when they travel as tourist to other nations, what happens to the domicile.

According to him Colombian civil code, every human being, without any distinction between national or foreign, has the right, only for the reason of staying in Colombia territory, to obtain a domicile in the nation.

Now, the question is if a person stays in a hotel in Colombia. Is he or she domiciled in Colombia? The answer is YES. The Supreme Court has declared that a residence, meaning the location where is at the time, can be considered as a domicile. For conclusion, the guy in the hotel can tell to the authorities that he has a domicile in Colombia’s territory in the hotels address but, he has another domicile in his own nation.

Well, many people could ask the reason why this is important. Just for some I could say:
1. Getting married, divorce or adopting children.
2. Paying taxes to the departments or the city.
3. Receive legal notice or have enterprises.

In conclusion, as a person whose domicile is Colombia, can defend his/her human rights and sue for protection through actions AS TUTELAS, that for most people they are only for Colombian citizens.

Of course speak with a tax lawyer in regard to US law. There alot of myths and rumors floating around about this law. If your an independent contractor such as i am your even more flexible. Some people think this is just a law for army guys, but this is false.

If you fall into this category you can be exempt from paying up to 80,000 in federal income taxes, however you still have to pay the Social Security, and workers comp taxes. In reality you will cut your taxes by 75% give or take.
