AOS Interview - No sweat

We went for our AOS interview today and it was about as quick and painless as it could be.

  • We showed up at 1:40 for our 2:30 appointment.

  • The officer led us in at 2:20.

  • She swore us in.

  • She Reviewed how we met and got married.

  • I gave them a photo copy of a check from our joint checking account and of our medical insurance cards

  • She looked at our photo album

  • Said she needed a signature from her boss but would approve it and the "green card" should arrive in a couple of weeks.

By 2:35 we were heading back to the car.
Now we can relax for a couple of years! (hooray!)

Well.... AOS = Adjustment Of Status

My fiance came in to the U.S. on a K-1. After we got married, and before her K-1 expired, she needed to file for an Adjustment of Status, basically changing her status from a K-1 fiance whose visa expires 90-days after entering the U.S. to a permanent resident. When that adjustment was approved, she became a conditional permanent resident. Two years from now, she'll have to reapply (and pay more money) to remove the "conditions" of her residency and become a permanent resident. So there are still a few more hoops to jump through.

Time-wise:

  • I filed the I-129F on Feb 1, 2005

  • Her K-1 was granted on Jul 21, 2005

  • She arrived in the U.S. Aug 5, 2005

  • We got married Oct 15, 2005

  • Sent in the I-485 packet Nov 1, 2005 (nothing like waiting 'til the last minute)

  • Her interview was today: Mar 14, 2006

So, from "0" to "green card" in 13 months isn't too bad considering were weren't trying to push it.

Q&A Big fees? Not for the USCIS. The airline tickets start to add up, though.

Rejection? I don't know the law, but my guess is that if you look like you have an honest-to-goodness relationship (e.g. dating, marriage, live like husband and wife, etc.) you won't have a problem.

If there is any thing out of the ordinary about your relationship, e.g. she lives in a different state from you after you are married, or you met through an "agency," only visited once, and received a large sum of money for your visit, you might have some explaining to do. They asked a lot of questions like: "Do you plan to commit any acts of terrorism against the United States" so I suppose answering "yes" to one of those might lower your chances as well.

One question that surprised me was they asked if I was a pilot. Well, I am, but I don't recall putting that down on any form. So my guess is that my number came up in some database search. If that's the case, then be careful if think you can pull something over on them. They know more then you might think they know. Also, the officers doing the interview have been doing this a long time, so my guess is they are better at spotting a fib then most people are at telling one.

We went through Seattle All the paperwork is sent to Chicago and then it is sent to the local office which, in our case, is Seattle. The AP came in January and the EAD came in February.

She's legal.. the green card (which is really beige on one side and white with green print on the other) came today, 10 days after the interview.

I do have to say, though, that it's quite a piece of technology.
Zowie! there are all kinds of different layers and secret marks, etc.

For now, I'll just be happy when it lets her back into the U.S.

Cool Well congratulations guys! Now she is oficially a "Permanent Condional Resident Alien etc etc etc".

I am glad it all worked out so fast for you :)

We received another notice of action notifying us the case was approved and that the green card should be arriving soon, so hopefully the misterious forces of the mail won't make my card get lost.
