PBH / colombia (travelguide, pictures) / post

anyone know if fiance can return to colombia and back to US with I-129f?

Angelica and I are talking about the possiblity of leaving her son with her mother a couple months while she comes here and gets situated (we are talking long and hard about this, it isnt easy for her to decide and I dont want to make that decision for her).

I am not sure how hard it would be for me to go and get him, since I am not the father.

I THINK I read somewhere that if she returns to Colombia and we arent married, she cant come back..

however what if we DO marry before she goes? I wonder how long it would take to get the correct visa or status change.

anyone? anyone?

You are correct. The K-1 Fiancee visa is a single entry visa for 90 days. If she leaves the United States before marrying you, she cannot re-enter the country on that visa. You would have to go through the whole process again. Either that or get married and bring her in on a K-3, a long process these days. Your other alternative is to go ahead with the marriage here and then file her I-485 to adjust her status along with a request (I-697 I think it is) for Advanced Parole. Normally a person who leaves the US while his/her AOS is pending is deemed to have abandoned the AOS. Advanced Parole is like a Get Out of Jail Free card - it allows the person to leave the country and re-enter while their AOS is pending. The problem with this approach is they take a long time to approve the I-697 so she will be stuck here for months waiting for her Advanced Parole to be approved. This is the one benefit of the K-3 Spousal visa, it is a multiple entry visa for 2 years and this allows the holder to leave the US and return even when they have an AOS pending without the need for Advanced parole.

Disclaimer: any comment I make is inane and is not to be taken seriously, and is so patently ridiculous that no one should take it seriously, even as an insult.
