Airport tax - New Rules and changes in law

I just spoke with Lawyer Co. (Esteban) here in Medellin. He is still making phone calls and contacting the Medellin airport for further information regarding the airport tax. You will find the related web-site below. It would appear major changes will take place regarding items brought into Colombia. I'm still confused about a laptop computer or cell phone being taxed at the airport. It may be confusing for the aduana inspector at the airport until they get this sorted out.

I would appreciate comments especially from those recently arriving via the airport.

EQUIPAJE PERSONAL HASTA POR US$1.500 NO TIENE QUE SER DECLARADO AL INGRESAR AL PAÃ?S

Bogotá, 21 jun (SNE). Los viajeros que ingresen al país tendrán derecho a traer equipaje acompañado, sin registro o licencia de importación y sin tener que declararlo en el formulario que entrega la Dirección de Impuestos y Aduanas Nacionales (Dian), hasta por un valor total de 1.500 dólares o su equivalente.
El Ministerio de Hacienda expidió el decreto 2287, fechado el 20 de junio, donde hace algunas modificaciones a la Sección X del decreto 2685 de 1999 o Legislación Aduanera.

El artículo 206 del decreto 2685 estableció que todo viajero que ingrese a territorio nacional tiene que presentar su equipaje a la autoridad aduanera, para lo cual diligenciará el formulario que prescriba la Dian, y se someterán a revisión de los funcionarios competentes de dicha entidad los elementos que componen el mismo, con el objeto de determinar el cumplimiento de las formalidades aduaneras y el pago de los derechos que correspondan.

Esa misma norma facultó a la autoridad aduanera a adoptar esquemas de revisión selectiva de los equipajes de los viajeros con el fin de facilitar la atención de los viajeros.
Otro decreto -el 1232 de 2001- advirtió que si el viajero omite declarar equipaje sujeto al pago del tributo único y la autoridad aduanera encuentra mercancías sujetas al pago del mismo, o mercancías en mayor valor o cantidad a las admisibles dentro del equipaje, las mercancías serán aprehendidas.

LO NUEVO
Lo nuevo introducido por el decreto 2287 del 20 de junio de 2007 es que de esa declaración en el formulario que entrega la Dian, se exceptúa, o no lo tiene que presentar, el equipaje que acompañe al viajero hasta por un valor total de mil quinientos dólares de los Estados Unidos de Norteamérica, o su equivalente y con franquicia del tributo único.

Además para la determinación del cupo de mercancías no se tendrán en cuenta los efectos personales que ingrese el viajero.

Otro hecho nuevo es que las autoridades aduaneras podrán exigir al viajero las facturas o los documentos que acrediten que las mercancías que trae se encuentran dentro del cupo autorizado de 1.500 dólares, para gozar de la franquicia del tributo único.


ART�CULO 208°. Equipaje con pago de tributo único. Los viajeros que ingresen al país y acrediten una permanencia mínima en el exterior de cinco (5) días calendario, tendrán derecho a traer como equipaje acompañado o no acompañado, sin registro o licencia de importación y con el pago del tributo único de que trata el artículo 209 del presente decreto, hasta tres (3) unidades de cada uno de los siguientes bienes: artículos de uso doméstico sean o no eléctricos, artículos deportivos y artículos propios del arte u oficio del viajero, hasta por un valor total de dos mil quinientos dólares de los Estados Unidos de Norteamérica (US$ 2.500) o su equivalente.

Taxes at the airport are a joke, I just flew out of Ft Lauderdale into Bogata and you should have seen the stuff Colombians were bringing back home. One old lady had two lap tops still in the Gateway boxes as hand luggage, one other couple had a 42 inch flat screen TV and about six large bags of ?. I was taking to one resident who had all sorts of biycle gear. I was wondering if the Duana only looks at Grinos stuff? O by the way I was heading to Cartagena and checked my bags through so passed through DAS in Bogata and came into Cartagena on a domestic flight so no baggage search in Cartagena or Bogata.

That BOATYGRINGO just described is exactly why you will soon see ENFORCEMENT of new tax laws and MORE DIAN AGENTS at the airports. Its the HIGH DOLLAR STUFF like computers, TV, cameras ect they will probably zero in on.

Boatygringo why didn't you take the direct flight out of MIA to Cartagena...I do the same shit I brought a huge LCD with me via American Airlines to Medellin and had no problems...No Duty and got lucky NO Oversize box charge had a nice counter lady..

1500.00 is reasonable but bring your receipts because maybe they won't believe you on the price because you get great deals in Miami..

MARIO, if you are bringing it in, you are IMPORTING IT. The problem is Gringos included, even people who are only here temporary are either leaving the stuff they bring here as gifts or selling it.

Biggest problem will be for the business traveler who needs his laptop, might be a LEAVE A DEPOSIT at the airport and get your money back when you depart WITH the taxed item, WHO KNOWS REMEMBER THIS IS COLOMBIA
